ORDINANCE NO. NS-1366
AN ORDINANCE OF THE CITY OF SANTA ANA
APPROVING AMENDMENT APPLICATION 764 TO
REZONE PROPERTY LOCATED AT FAIRVIEW STREET
AND MACARTHUR BOULEVARD FROM THE R2-PRD
(PLANNED RESIDENTIAL DEVELOPMEN~ DISTRICT
TO THE C4 (PLANNED SHOPPING CENTER) DISTRICT
AND AMENDING SECTIONAL DISTRICT MAPS 27-5-10
AND 34-5-10
WHEREAS, the Planning Commission has given
notice and duly held a public hearing on Amendment Applica-
tion 764, filed by C. J. Segerstrom and Sons to rezone property
located at the southeast corner of Fairview Street and Mac-
Arthur Boulevard from the R2-PRD (Planned Residential De-
velopment) District to the C4 (Planned Shopping Center) Dis-
trict, and said Commission has recommended approval of the
said application, and
WHEREAS, the City Council regularly held a public
hearing on said reclassification on published notice required
by law, and does now find that the public necessity, conven-
ience, and general welfare require that said property be re-
classified from the R2-PRD (Planned Residential Development)
District to the C4 (Planned Shopping Center) District, and
that such new classification will not be detrimental to the
surrounding property, and
WHEREAS, this Council, prior to taking this action
has reviewed and considered the information contained in that
Environmental Impact Report designated as "Environmental Im-
pact Report 76-4", has approved said document as the final
environmental impact report for the General Plan amendment
hereby adopted, and finds that social and economic conditions
render infeasible the alternative of retaining the parcels
in their existing land use designations,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
SANTA ANA DOES ORDAIN AS FOLLOWS:
SECTION 1: That the real property located in the
City of Santa Ana, described on Exhibit AA 764-A on file in
the records of the Planning Director, is hereby reclassified
from the R2-PRD (Planned Residential Development) District
to the C4 (Planned Shopping Center) District, and that Sec-
tional District Maps 27-5-10 and 34-5-10 are hereby amended
to show such reclassification in accordance with Exhibit
AA 764-A.
SECTION 2: If any section, subsection, sentence,
clause, phrase or portion of this ordinance is for any rea-
son held to be invalid or unconstitutional by the decision
of any court of competent jurisdiction, such decision shall
not affect the validity of the remaining portions of this
ordinance. The City Council of the City of Santa Ana hereby
declares that it would have adopted this ordinance and each
section, subsection, sentence, clause, phrase or portion

thereof irrespective of the fact that any one or more sec-
tions, subsections, clauses or portions be declared invalid
or unconstitutional.
