NS-1379 AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING AMENDMENT APPLICATION NO. 767 FILED BY BERNARD & SPENGLER TO REZONE PROPERTY ON THE EAST SIDE OF FAIRVIEW STREET BETWEEN SEVENTEENTH STREET AND EDNA DRIVE FROM THE LP (LIMITED PRO- FESSIONAL) AND C 1 (COMMUNITY COMMERCIAL) DISTRICTS TO THE R 1 (SINGLE FAMILY RESI- DENCE) DISTRICT AND AMENDING SECTIONAL DISTRICT MAP 2-5-10. WHEREAS, the real property located on the east side of Fairview Street between Seventeenth Street and Edna Drive in the City of Santa Aha and more particularly described infra, is located within the LP (Limited Professional) and C 1 (Community Commercial) districts; and WHEREAS, an application has been filed to amend Sectional District Map 2-5-10 to rezone such real property to the R 1 (Single-Family Residence)district; and WHEREAS, the Planning Commission has given notice of and duly held a public hearing on Amendment Application No. 767 to rezone such real property from the LP (Limited Professional) and C 1 (Community Commercial) Districts to the R 1 (Single-Family Residence) District and has recommended approval of said application; and WHEREAS, the City Council regularly held a public hearing on said reclassification on published notice as required by law and does now find that the public necessity, convenience, and general welfare require that said property be reclassified from the LP (Limited Professional) and C 1 (Community Commercial) to the R 1 (Single-Family Residence) District, and that the new classification will not be detrimental to the surrounding property; and WHEREAS, prior to taking this action, the City Council has reviewed and considered the information contained in Nega- tive Declaration No. 77-150, and, on the basis thereof, finds that the project will not have a significant effect upon the environment, NOWt THEREFORE v THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That the real property situated in the City of Santa Ana, County of Orange, State of California, generally located at the east side of Fairview Street between Seventeenth Street and Edna Drive, and more particularly des- cribed as the west 137.5 feet of Tract No. 9631 as recorded in Book 411, pages 11 through 14 inclusive, of Tract Maps, Records of Orange County, State of California, is hereby reclassified from the LP (Limited Professional) and C 1 (Community Commercial) Districts to the R 1 (Single Family Residence) District, and that Sectional District Map 2-5-10 is hereby amended to show said reclassification, in accordance with Exhibit AA 767A. SECTION 2: Neither the adoption of this Ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal pro- visions applicable to any violations thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to ORDINANCE NO. NS-1379 PAGE TWO be posted, filed or deposited pursuant to any ordinance, and all rights and obligations thereunder appertaining shall con- tinue in full force and affect. SECTION 3: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, clauses or portions be declared invalid or unconstitutional.
