ORDINANCE NO. NS-1582
AN ORDINANCE OF THE CITY OF SANTA ANA APPROV-
ING AMENDMENT APPLICATION NO. 768 TO RE,lONE
PROPERTY LOCATED AT 901 - 914 VIRGINIA AVENUE
FROM THE A-1 (GENERAL AGRICULTURE) DISTRICT TO
THE R-1 (SINGLE FAMILY RESIDENTIAL) DISTRICT AND
AMENDING SECTIONAL DISTRICT MAP 6-5-9.
WHEREAS, the real property commonly known at 901- 914
Virginia Avenue, located at the west terminus of Virginia
Avenue, west of Lincoln Street, in the City of Santa Ana and
more particularly described infra, is located within the A-1
(General Agriculture) District; and
WHEREAS, an application has been filed to amend
Sectional District Map 6-5-9 to rezone such real property to
the R-1 (Single Family Residential) District; and
WHEREAS, the Planning Commission has given notice of
and duly held a public hearing on Amendment Application No.
768 to rezone such real property from the Aml (General Agricul-
ture) District to the R-1 (Single Family Residential) District
and has recommended approval of said application; and
WHEREAS, the City Council published notice as re-
quired by law, regularly held a public hearing on said reclassi-
fication, and does now find that the public necessity, conven-
ience, and general welfare require that said property be re-
classified from the A-1 (General Agriculture) District to the
R-1 (Single Family Residential) District, and that the new
classification will not be detrimental to the surrounding
property; and
WHEREAS, the proposed zoning will conform to the
General Plan designation of low density residential; and
WHEREAS, prior to taking this action, the City Council
has reviewed and considered the information contained in Nega-
tive Declaration No. 77-166, and, on the basis thereof, finds
that the project will not have a significant effect upon the
environment,
NOW THEREFORE~ THE CITY COUNCIL OF THE CITY OF
SANTA ANA DOES ORDAIN AS FOLLOWS:
SECTION 1: That the real property situated in the City
of Santa Ana, County of Orange, State of California, commonly
known as 901 - 914 Virginia Avenue, and more particularly des-
cribed as Lots 1 through 8, inclusive, of Tract 9696, is hereby
reclassified from the A-1 (General Agriculture) District to the
R-1 (Single Family Residential) District, and that Sectional
District Map 6-5-9 is hereby amended to show such reclassifica-
tion in accordance with Exhibit AA 768-A.
SECTION 2: If any section, subsection, sentence,
clause, phrase or portion of this ordinance is for any reason
held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decision shall not affect
the validity of the remaining portions of this ordinance. The
City Council of the City of Santa Ana hereby declares that it
would have adopted this ordinance and each section, subsection,
sentence, clause, phrase or portion thereof irrespective of
the fact that any one or more sections, subsections, clauses,
or portions be declared invalid or unconstitutional.

SECTION 3: Neither the adoption of this ordinance
nor the repeal hereby of any ordinance shall in any manner
affect the prosecution for violation of ordinances, which
violations were committed prior to the effective date hereof,
nor be construed as affecting any of the provisions of such
ordinance relating to the collection of any such license or
penalty nor the penal provisions applicable to any violation
thereof, nor to affect the validity of any bond or cash de-
posit in lieu thereof, required to be posted, filed or de-
posited pursuant to any ordinance and all rights and obliga-
tions thereunder appertaining shall continue in full force
and effect.
