ORDINANCE NO. NS-1583
AN ORDINANCE OF THE CITY OF SANTA ANA
APRPOVING AMENDMENT APPLICATION NO. 770
TO REZONE PROPERTY LOCATED AT 4910
WEST FIFTH STREET FROM THE A1 (GENERAL
AGRICULTURE) DISTRICT TO THE R2-PRD
(MULTIPLE FAMILY RESIDENCE) DISTRICT
AND AMENDING SECTIONAL DISTRICT MAP
NO. 9-5-10.
WHEREAS, the real property commonly known as 4910
West Fifth Street, located on the south side of Fifth Street
between Euclid Street and the Orange County Flood Control
District Channel, and more particularly described infra,
is located in the A1 (General Agriculature) District, and
WHEREAS, an application has been filed to amend Sectional
District Map No. 9-5-10 to rezone such real property to the R2-PRD
(MultiPle Family Residence) District, and
WHEREAS, the Planning Commission has given notice of
and duly held a public hearing on Amendment Application No.
770 to rezone such property from the A1 (General Agriculture)
District to the R2-PRD (Multiple Family Residence) District
and has recommended approval of said application, and
WHEREAS, the City Council published notice as required
by law and regularly held a public hearing on said reclassifi-
cation and does now find that the public necessity, convenience,
and general welfare require that said property be reclassified
from the A1 (General Agriculture) District to the R2-PRD
(Multiple Family Residence) District, and that the new classifi-
cation will not be detrimental to the surrounding property, and
WHEREAS, prior to taking this action the City Council has
reviewed and considered the information contained in Negative
Declaration No. 77-180, and, on the basis thereof, finds that the
project will not have a significant effect upon the environment,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA
DOES ORDAIN AS FOLLOWS:
Section 1: That the real property situated in the City
of Santa Ana, County of Orange, State of California, commonly
known as 4910 West Fifth Street, generally located on the south
side of Fifth Street between Euclid Street and the Orange County
Flood Control District Channel, and more particularly described
on Exhibit "A" attached hereto and incorporated by reference
herein, is hereby reclassified from the A1 (General Agriculture)
District to the R2-PRD (Multiple Family Residence) District, and
that Sectional District Map No. 9-5-10 is hereby amended to show
said reclassification in accordance with Exhibit AA 770-A.
Section 2: If any section, subsection, sentence,
clause, phrase, or portion of this ordinance is for any reason
held to be invalid or unconstitutional by the decision of
any court of competent jurisdiction, such decision shall not
affect the validity of the remaining portions of this ordinance.

The City Council of the City of Santa Ana hereby declares that it
would have adopted this ordinance and each section, subsection,
clause, phrase or portion thereof irrespective of the fact that
any one or more sections, subsections, clauses, phrases or por-
tions be declared invalid or unconstitutional.

Conmnencing at the intersection of the centerline of Euclid Street with the
centerline of Fifth Street; thence easterly along the centerline of Fifth
Street 929 feet ~ to the True Point of Beginning: thence continuing easterly
along the centerline of Fifth Street, 476 feet ~ to a point in said centerline;
thence southerly along a line perpendicular to the centerline of Fifth Street
a distance of 30 feet to a point in the southerly right of way line of Fifth
Street, 60 feet wide; said point also being a point in the westerly line of
the right of way of the Orange County Flood Control District channel; thence
southwesterly and southerly along said westerly line, which is a curve concave
southeasterly with a radius of 1,500 feet, an arc length of 514 feet ~ to a
tangent point; thence southerly along said tangent line a distance of 141 feet ±;
thence westerly along a line parallel with the centerline of Fifth Street a
distance of 395 feet ~; thence northerly along a line perpendicular to the
centerline of Fifth Street a distance of 619 feet ~; thence easterly along a
line parallel to the centerline of Fifth Street a distance of 3 feet ~; thence
northerly along a line perpendicular to the centerline of Fifth Street a
distance of 55 feet ~ to the True Point of Beginning.
