ORDINANCE NO. NS-1400
AN ORDINANCE OF THE CITY OF SANTA ANA
APPROVING AMENDMENT APPLICATION NO. 780
TO REZONE PROPERTY LOCATED ON NEW=HOPE
STREET BETWEEN FIRST AND THIRD STREETS
FROM THE A1 (GENERAL AGRICULTURE) AND
C2 (GENERAL COMMERCIAL) DISTRICTS TO THE
R2-PRD (MULTIPLE FAMILY RESIDENCE - PLAN-
NED RESIDENTIAL DEVELOPMENT) DISTRICTS
AND AMENDING SECTIONAL DISTRICT MAP NO.
9-5-10.
WHEREAS, the real property located on Newhope Street
between First and Third Streets in the City of Santa Ana and
more particularly described infra, is located within the A1
(General Agriculture) and C2 (General Commercial) Districts,
and
WHEREAS, an application has been filed to amend Sectional
District Map No. 9-5-10 to rezone such real property to the
R2-PRD (Multiple Family Residence - Planned Residential Develop-
ment) District, and
WHEREAS, the Planning Commission has given notice of
and duly held a public hearing on Amendment Application No. 780
to rezone such real property from the A1 and C2 Districts to
the R2-PRD District and has recommended approval of said appli-
cation, and
WHEREAS, the City Council regularly held a public hearing
on said reclassification on published notice required by law
and does now find that the public necessity, convenience, and
general welfare require that said property be reclassified
from the A1 and C2 Districts to the R2-PRD District, and that
the new classification will not be detrimental to the surrounding
property, and
WHEREAS, prior to taking this action, the City Council
has reviewed and considered the information contained in Negative
Declaration No. 77-250, and, on the basis thereof, finds that
the project will not have a significant effect upon the environ-
ment;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
ANA DOES ORDAIN AS FOLLOWS:
Section 1: That the real property situated in the
City of Santa Ana, County of Orange, State of California, gener-
ally located on Newhope Street between First and Third Streets,
and more particularly described on Exhibit A, attached hereto
and incorporated by reference herein, is hereby reclassified
from the A1 (General Agriculture) and C2 (General Commercial)
Districts to the R2-PRD (Multiple Family Residence - Planned
Residential Development) District, and that Sectional District
Map No. 9-5-10 is hereby amended to show said reclassification
in accordance with Exhibit AA 780-A.
Section 2: If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held to

be invalid or unconstitutional by the decision of any court
of competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this ordinance. The
City Council of the City of Santa Ana hereby declares that
it would have adopted this ordinance and each section, subsection,
sentence, clause, phrase or portion thereof irrespective of
the fact that any one or more sections, subsections, clauses
or portions be declared invalid or unconstitutional.

PREAMBLE: That portion of the southeast quarter of the southeast quarter
of Section g, Township 5 south, Range l0 west; in the City of Santa Ana,
County of Orange, State of California, as shown on a map filed in Book 51
page 12 of Miscellaneous Maps, records of said Orange County described as
follows:
PARCEL l: All of that certain parcel of land as shown on a map filed in
Book 17, page 45 of Parcel Maps, records of Orange County, California,
and identified as "Residual Parcel," together with the west 30.00 feet of
Newhope Street lying directly east of said "Residual Parcel."
EXCEPTING therefrom the following described parcel: Beginning at the inter-
section of the easterly prolongation of the southerly line of said residual
parcel with the centerline of Newhope Street (60 feet wide); thence south
89°24'20" west, 180.41 feet; thence south 0o34'58'' east, 3.76 feet; thence
south 89°24'20" west, 30.00 feet; thence north 0°34'58'' west, 31.76 feet;
thence north 89o24'20" east, 210.41 feet, more or less; thence south
0°34'32'' east, 28.00 feet to the Point of Beginning.
PARCEL 2: All that certain real property described as: all of the north
432.42 feet of the following described real property:
That portion of the west one-half of the southeast quarter of the southeast
quarter of the southwest quarter of Section 9, Township 5 south, Range l0
west, S.B.B. & M. described as follows:
Beginning at a point in the south line of said Section 9, 430.88 feet west
of the south quarter corner thereof, running thence north 675.57 feet, more
or less, to the north line of the southeast quarter of the southeast quarter
of the southwest quarter of said Section 9; thence west along said north
line, lO0.71 feet, more or less, to the northeast corner of the west two
acres of the west one-half of the southeast quarter of the southeast quarter
of the southwest quarter of said Section 9; thence south along the east line
of said west two acres 675.44 feet, more or less, to the south line of said
Section 9; thence east along said south line, 100.62 feet, more or less, to
the Point of Beginning.
PARCEL 3: The northerly 123.13 feet of Parcel 1 as shown on a map filed in
Book 17, page 45 of Parcel Maps, records of Orange County, California, in the
City of Santa Ana, County of Orange, State of California.
EXCEPTING therefrom the east 30.00 feet thereof.
