ORDINANCE NO. NS-1413
AN ORDINANCE OF THE CITY OF SANTA ANA AMEND-
ING SECTIONS 8-43, 8-99, AND 8-157 OF
THE SANTA ANA MUNICIPAL CODE, ADDING SECTIONS
8-60, 8-61, 8-120, 8-163, AND 8-179 THERETO,
AND REPEALING SECTIONS 8-100, 8-102, 8-109,
8-110, AND 8-111 THEREOF, TO ADOPT THE 1976
EDITION OF THE UNIFORM BUILDING CODE WITH
CERTAIN AMENDMENTS THERETO
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES
ORDAIN AS FOLLOWS:
SECTION 1: That section 8-43 of the Santa Ana Municipal
Code, is hereby amended to read as follows:
Sec. 8-43. Adoption by reference.
There is adopted by the City that certain code known as
the Uniform Building Code, 1976 Edition, and the whole
thereof, together with the appendices therein and the
1976 Edition of the Uniform Building Code Standards,
save and except such portions as are deleted by the
amendments set forth in this Article, of which said
code not less than three (3) copies have been and are
on file in the office of the Clerk of the Council of
the City. The said code is adopted and incorporated as
fully as if set forth at length herein as provided for
in Section 419 of the Charter of the City, and, subject
to all amendments set forth in this Article, shall be
in effect within the City of Santa Ana from the effec-
tive date of this ordinance. Any provision of this
Article amending the "Building Code" or "Uniform
Building Code" shall be construed as amending the said
adopted code, 1976 Edition, including such provisions
enacted prior to the enactment of this ordinance and
not thereafter repealed. The said adopted code, 1976
Edition, as thus amended, together with all other
provisions of this Article, shall be known as the
Building Code of the City of Santa Ana.
SECTION 2: That the Santa Ana Municipal Code, is
hereby amended by adding a section, to be numbered 8-60, to
Division 2 of Article II of Chapter 8 thereof, which said
section reads as follows:
Sec. 8-60. Application to existing buildings (Sec-
tion 104(a)).
Section 104(a) of the Building Code is amended by
adding a sentence thereto, to read as follows:
See section 1413 for code provisions requiring in-
stallation of smoke detectors in existing Group R,
Division 3 occupancies.
SECTION 3: That the Santa Ana Municipal Code, is
hereby amended by adding a section, to be numbered 8-61,
which said section reads as follows:
Sec. 8-61. Same (Section 104(b)).
Section 104(b) of the Building Code is amended by
adding a paragraph thereto, to read as follows:
Exception: Additions, alterations, and repairs to
Group R Occupancies exceeding 50 percent of the value
of an existing building or structure may be made to

such building or structure within any 12-month period
without making the entire building or structure comply.
The new construction shall conform to the requirements
of this Code for a new building of like area, height,
and occupancy. Such building or structure, including
new additions, shall not exceed the areas and heights
specified in this Code.
SECTION 4: That section 8-99 of the Santa Ana Muni-
cipal Code, is hereby amended to read as follows:
Sec. 8-99. Fees (Section 303).
Section 303 of the Building Code is amended to read as
follows:
Fees and charges for building permits, plan checking,
reinspection, and investigations shall be established
and regulated by resolution of the City Council.
SECTION 5: That sections 8-100, 8-102, 8-109, 8-110,
and 8-111 of the Santa Ana Municipal Code are hereby repealed.
SECTION 6: That the Santa Aha Municipal Code, is
hereby ~mended by adding a section, to be numbered 8-120,
which said section reads as follows:
Sec. 8-120. Fire Warning System (Section 1413).
Section 1413 of the Building Code is amended by adding
two paragraphs thereto, to read as follows:
When alterations, repairs, or additions requiring a
permit and having a valuation in excess of $1,000
occur, or when one or more sleeping rooms are added or
created in existing Group R, Division 3 Occupancies,
the entire building shall be provided with smoke
detectors located as required for new Group R, Division
3 Occupancies.
In new construction, required smoke detectors shall
receive their primary power from the building wiring
when such wiring is served from a commercial source.
Wiring shall be permanent and without a disconnecting
switch other than those required for overcurrent pro-
tection. Smoke detectors may be battery operated when
installed in existing building, or in buildings without
commercial power, or in buildings which undergo altera-
tions, repairs, or additions regulated by the second
paragraph of this Section.
~SECTION 7: That section 8-157 of the Santa Ana Muni-
cipal Code, is hereby amended to read as follows:
Sec. 8-157. Exception for minor buildings (Section
1603(a)).
Section 1603(a) of the Building Code is amended by
adding an exception after the second paragraph, to read as
follows:
EXCEPTION: Fire-resistive construction of exterior
walls shall not be required on detached Group B or M
occupancy buildings having an area of not more than
four hundred (400) square feet when such building is
ten (10) feet or more from the adjacent property line
and not less than ten (10) feet from any building on
the same building site.

SECTION 8: That the Santa Ana Municipal Code, is
hereby amended by adding a section to be numbered 8-163,
which said section reads as follows:
Sec. 8-163. Type of lock or latch (Section 3303(c)).
Section 3303(c) of the Building Code is amended by
amending the exception set forth therein to read as follows:
EXCEPTION: This requirement shall not apply to ex-
terior exit doors in a Group B Occupancy if there is a
readily visible, durable sign on or adjacent to the
door, stating "THIS DOOR TO REMAIN UNLOCKED DURING
BUSINESS HOURS." The sign shall be in letters not less
than 1 inch high on a contrasting background. Except
for office suites housing one tenant, the locking
device must be of a type that will be readily dis-
tinguishable as locked. The use of this Exception may
be revoked by the Building Official for due cause.
SECTION 9: That the Santa Aha Municipal Code, is
hereby amended by adding a section, to be numbered 8-179,
which said section reads as follows:
Sec. 8-179. Agricultural buildings (Appendix Chapter
15)
The Uniform Building Code is amended by deleting the
provisions pertaining to Chapter 15 in the Appendix
thereof, including Table No. 15-A, therein.
SECTION 10: If any section, subsection, sentence,
clause, phrase or portion of this ordinance is for any
reason held to be invalid or unconstitutional by the de-
cision of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of
this ordinance. The City Council of the City of Santa Aha
hereby declares that it would have adopted this ordinance
and each section, subsection, sentence, clause, phrase or
portion thereof irrespective of the fact that any one or
more sections, subsections, sentences, clauses, phrases or
portions be declared invalid or unconstitutional.
'SECTION 11: Neither the adoption of this ordinance nor
the rePeal hereby of any ordinance shall in any manner
affect the prosecution for violation of ordinances, which
violations were committed prior to the effective date hereof,
nor be construed as affecting any of the provisions of such
ordinance relating to the collection of any such license or
penalty or the penal provision applicable to any violation
thereof, nor to affect the validity of any bond or cash
deposit in lieu thereof, required to be posted, filed or
deposited pursuant to any ordinance and all rights and
obligations thereunder appertaining shall continue in full
force and effect.
SECTION 12: The modification to section 1413 of the
Uniform Building Code is hereby found to be reasonably
necessary because of local conditions for the reason that
smoke detectors have been found to be extremely effective in
saving lives in residential occupancies in the City of Santa
Aha, such that it is reasonable to require an owner of an
existing residential building to incur the relatively minor
expense of installation of such smoke detectors when such
owner proposes to make a substantial improvement to his
property. It is further found that this modification has
been approved for inclusion in the next edition of the
Uniform Building Code.
