NS-1450.1 AN EMERGENCY ORDINANCE OF THE CITY OF SANTA ANA FIXING THE RATE OF AND LEVY- ING TAXES IN THE AMOUNT OF EIGHTY-SIX CENTS PER ONE HUNDRED DOLLARS OF ASSESSED VALUATION ON ALL TAXABLE PROPERTY IN THE CITY FOR ALL MUNICIPAL PURPOSES, BEGINNING JULY 1, 1978, AND ENDING JUNE 30, 1979, AND STATING THE REASONS FOR ITS URGENCY THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: For all amounts required for the usual and current expenses for municipal purposes for the fiscal year beginning July 1, 1978, and ending June 30, 1979, a tax of eight-six cents (.86~) is hereby levied upon each one hundred dollars ($100.00) of assessed valuation of all taxable property in the City of Santa Ana. Said tax is hereby apportioned among the various funds as follows: For the GENERAL FUND, $ .20 the taxable property in said City; on each $100.00 of For the LIBRARY FUND, $ .15 the taxable property in said City; on each $100.00 of For the RECREATION AND PARK FUND, $ .06 $100.00 of the taxable property in said City; on each For the CAPITAL IMPROVEMENT FUND, $ .09 $100.00 of the taxable property in said City; on each For the RETIREMENT FUND, $ .36 of the taxable property in said City. on each $100.00 SECTION 2: This ordinance shall take effect upon the date of publication hereof. SECTION 3: The Clerk of the Council shall transmit to the County Auditor of Orange County a certified copy of this ordinance. SECTION 4: The Clerk of the Council shall cause the title of this ordinance to be published in "The Register" within two (2) days after its adoption. SECTION 5: This Council finds that this ordinance is urgently required as an emergency ordinance for the immediate preservation of the public peace, health, and safety for the following reasons: (a) Certain amendments to the California Constitu- tion establishing a maximum tax rate as approved by the voters, popularly known as "Proposition 13", is currently under Cali- fornia Supreme Court review; (b) California Government Code Section 51551 re- quires a certified copy of an ordinance establishing the tax rate to be delivered to the County Auditor by September 1, 1978; (c) If, for any reason, "Proposition 13" is invalidated by the California Supreme Court, the City of Santa Ana would be left without an established tax rate. ORDINANCE NO. NS- 1450.1 PAGE TWO THEREFORE, the City Council declares that this ordinance shall take effect, and be adopted, as an emergency measure and is to be enforced from the date of publication of title as required by the Charter of the City of Santa Ana.
