ORDINANCE NO. NS-1469
AN EMERGENCY ORDINANCE OF THE CITY OF SANTA
ANA EXTENDING ORDINANCE NO. NS-1447 FOR AN
ADDITIONAL FOUR MONTHS AND PROHIBITING ISSUANCE
OF BUILDING PERMITS, VARIANCES, CONDITIONAL USE
PERMITS, OR MINOR EXCEPTIONS IN THE AP~EA GEN-
ERALLY BOUNDED BY THE SANTA ANA FREEWAY ON THE
NORTH, LINCOLN AVENUE ON THE EAST, SANTA ANA
BOULEVARD ON THE SOUTH, AND SANTIAGO AVENUE
ON THE WEST, EXCEPT UNDER SPECIFIED CONDITIONS
FOR SUCH INTERIM PERIOD PENDING AMENDMENT OF
THE GENERAL PLAN AND THE MUNICIPAL CODE: AND
STATING THE REASONS FOR ITS URGENCY.
WHEREAS, on August 21, 1978, the City Council of
the City of Santa Ana enacted Ordinance No. NS-1447, an
emergency ordinance prohibiting issuance of various permits
for an interim period pending completion of an Environmental
Impact Report for the potential rezoning of the Logan area,
General Plan amendment, and change of specific street align-
ment for Civic Center Drive East; and
WHEREAS, said ordinance is effective for four (4)
months thereafter; and
WHEREAS, the City Council now finds that an extension
of said ordinance for an additional four (4) months, for a
total of eight (8) months, is necessary in order to afford
sufficient time to complete the aforesaid Environmental Impact
Report for the potential rezoning, General Plan amendment and
specific street alignment;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
SANTA ANA DOES ORDAIN AS FOLLOWS:
SECTION 1: Ordinance No. NS-1447 is hereby extended
for an additional period of four months. Except as hereafter
provided, the issuance of building permits pursuant to Chapter
8 of the Santa Ana Municipal Code, or the granting of minor
exceptions, variances or conditional use permits pursuant to
Chapter 41 of the Santa Ana Municipal Code, is hereby prohib-
ited in the area generally bounded by the Santa Ana Freeway
on the north, Lincoln Avenue on the east, Santa Ana Boulevard
on the south, Santiago Avenue to Civic Center Drive on the
southwest, 190 feet east of the centerline of Santiago Avenue
on the west, and 384 feet east of the centerline of Santiago
Avenue on the northwest, hereinafter referred to as "the
Logan Area" and more fully delineated on the map marked
"Exhibit A," attached hereto and incorporated herein by ref-
erence, during the effective period of this ordinance.
SECTION 2: Notwithstanding any provision herein to
the contrary, any building permit authorized by Chapter 8 of
the Santa Ana Municipal Code, or minor exceptions, variances,
or conditional use permits authorizee by Chapter 41 of the
Santa Aha Municipal Code, may be issued within the Logan Area
where the property involved is residential in character, or
where the proposed construction, alteration or repair does
not exceed five thousand dollars ($5,000.00) in value, or
where an emergency as determined by the appropriate issuing
authority exists.

SECTION 3: This ordinance shall be effective for
a period of an additional four (4) months after the expira-
tion of Ordinance NS-1447, a total of eight (8) months com-
mencing August 21, 1978, unless extended, repealed or modi-
fied by ordinance adopted by this Council.
SECTION 4: This Council finds that this ordinance
is urgently required as an emergency ordinance for the immedi-
ate preservation of the public peace, health, and safety
for the following reasons:
(a) An Environmental Impact Report is presently
under preparation for the potential rezoning of the Logan
area, General Plan amendment and change of specific street
alignment for Civic Center Drive East;
(b) The issuance of permits pursuant to Chapter
8 of the Santa Aha Municipal Code or minor exceptions,
variances or conditional use permits pursuant to Chapter 41
of the Santa Ana Municipal Code may have an adverse effect
on the proposed development of the Logan area as a residential
community;
(c) Amendment of the General Plan and the zoning
provisions of the Santa Ana Municipal Code may be required
to regulate the location of uses in the Logan area in order
to avoid or mitigate such adverse effects;
(d) Unless prohibited during the period of re-
view and study preliminary to enactment of such General Plan
amendment and ordinance, such use of property is likely to
be initiated in conflict with such amendment and ordinance
as finally enacted.
THEREFORE, the City Council declares that this
ordinance shall take effect, and be adopted, as an emergency
measure and is to be enforced from the date of publication
of title as required by the Charter of the City of Santa Ana.
