ORDINANCE NO. NS-1471
AN ORDINANCE OF THE CITY OF SANTA ANA DECLARING
A VACANCY IN THE OFFICE OF COUNCILMAN IN WARD
FIVE AND PROVIDING FOR THE HOLDING OF A SPECIAL
MUNICIPAL ELECTION IN THE CITY OF SANTA ANA,
CALIFORNIA, ON THE THIRD DAY OF APRIL, 1979, FOR
THE ELECTION OF ONE MEMBER OF THE CITY COUNCIL,
GIVING NOTICE OF SAID ELECTION, HOURS DURING
WHICH THE POLLS SHALL BE OPEN, AUTHORIZING APPOINT-
MENT OF ELECTION OFFICERS TO SERVE AT SAID ELECTION;
AND ORDERING SAID SPECIAL MUNICIPAL ELECTION TO BE
CONSOLIDATED WITH THE GENERAL MUNICIPAL ELECTION TO
BE HELD ON SAID DATE.
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES
ORDAIN AS FOLLOWS:
SECTION 1: That the office of Councilman, Ward
Five, is hereby declared vacant by reason of the resignation
of the incumbent therein, effective April 9, 1979. A Special
Municipal Election is hereby called to be held in the City
of Santa Ana, California, on April 3, 1979 to fill said office
for the unexpired term thereof, as hereinafter specified.
SECTION 2: That there shall be 75 voting pre-
cincts, several of which are single State and County precincts
renumbered for said Election and the rest of which consist
of consolidations of State and County Precincts, all consist-
ing of territory within the City of Santa Ana.
SECTION 3: That the Precinct Board of each precinct
shall consist of one Inspector, one Judge, and two Clerks;
and that said Precinct Officers shall receive the following
compensation for their services: Inspectors, $29.00, Judges
and Clerks, $24.00, and owners of privately owned polling
places shall receive the sum of $15.00 for the use of each
polling place.
SECTION 4: That the consolidated voting precincts,
the polling places thereof, and the Precinct Board for each
such precinct shall be as set out on that certain document
headed "ELECTION OFFICERS AND POLLING PLACES" on file in the
office of the Clerk of the Council, and the Boards of each
such voting precinct are hereby appointed. The Clerk of the
Council is hereby authorized to find and appoint substitutes
for any election officer hereby appointed who is unable or
unwilling to act.
SECTION 5: That said Election shall be held and
conducted in accordance with the provisions of the Charter
of the City of Santa Ana, the Constitution of the State of
California, and the provisions of the Elections Code of the
State of California insofar as the same may be applicable
thereto. On the day of the Election the polls shall be opened
at 7:00 a.m. and shall be kept open until 8:00 p.m., at which
time the polls shall be closed. The Clerk of the Council
shall prepare and cause to be published a NOTICE OF ELECTION
for one time; a list of names of the nominees in the order
in which they will appear on the Ballot and the office for
which they are nominated once a week for two successive weeks,
with at least five (5) intervening days between the dates
of publication; and a notice of election officers and polling

places for one time.
SECTION 6: The Clerk of the Council shall prepare
and cause to be printed official ballots and election supplies
necessary for the holding of said Election as required by law,
and sample ballots and polling place cards, and shall provide
for the mailing of the same to each registered elector within
the City.
SECTION 7: That said Special Municipal Election is
held to fill the office for the term as follows:
One (1) member of the City Council, to
be nominated from Ward Five and to be
elected at large by the electors of the
City, the term to begin on April 10,
1979, or as soon thereafter as the re-
sult of said Election can be declared,
and to hold office until the second
Tuesday of April, 1981.
SECTION 8: That said Special Municipal Election
is hereby ordered to be consolidated with the General Mun-
icipal Election to be held in this City on April 3, 1979.
