ORDINANCE
AN ORDINANCE OF THE CITY OF SANTA A~ ~\_j.~_~.\~\~
ORDERING, CALLING, PROVIDING FOR AND , ~ -'

ON APRIL 3, 1979, FOR TEE PURPOSE OF
SUBMITTING TO THE QUALIFIED VOTERS OF
TEE SAID CITY CERTAIN PROPOSALS TO AMEND
TEE CHARTER OF SAID CITY
WHEREAS, the City Council of the City of Santa Ana
desires that a special municipal election be combined with
the general election to be held on April 3, 1979, for the
purpose of submitting a certain proposed amendment to the
Charter of the City of Santa Ana to the qualified voters of
said City; and
WHEREAS, the City Council has requested the Board
of Supervisors of Orange County, pursuant to Resolution
No. 79-4, to permit the Registras of Voters to render speci-
fied services to said City relating to the general election
to be held in said City on April 3, 1979;
NOW, THEREFOREv THE CITY COUNCIL OF THE CITY OF
SANTA ANA DOES ORDAIN AS FOLLOWS:
Section 1: That a special election be combined with
the general election and be held and the same is hereby called
to be held, in the City of Santa Aha on April 3, 1979, for the
purpose of submitting to the qualified voters of said City the
proposal set forth in Exhibit A, attached hereto and made a part
hereof, to amend the Charter of the City of Santa Ana.
Section 2: That on the ballot to be used at said
special election, in addition to other matters required by law,
there shall be printed substantially the provisions of Exhibit A.
Section 3: That the proposals pursuant to Exhibit A
hereof shall be designated on the ballot by a letter, pursuant
to Section 10219 of the Elections Code of the State of California.
Section 4: That the said special municipal election
shall be conducted an accordance with the Elections Code of the
State of California, and the Clerk of the Council is hereby author-
ized and directed to take all actions necessary or appropriate with
respect thereto, except to the extent such actions may be under-
taken by the Registrar of Voters of the County of Orange.
Section 5: That notice of the time and place of
holding said special municipal election is hereby given, and
the Clerk of the Council is hereby authorized and directed to
give such additional notice thereof as required by law.

EXHIBIT A
Ballot lan~.ua~e:
REVENUE AND TAXATION. Shall the Charter be [ ] YES
amended to revise the budget adoption procedure by
prohibiting yearly budget growth greater than 3% and [ ] NO
salary, wages and fringe benefits greater than 70%
of the budget without an affirmative vote of the electors.
Proposed amended charter language:
Sec. 607. Same - further consideration and adoption.
After the conclusion of the public hearing, the
city council may further consider the proposed budget and
make any revisions thereof that it may deem advisable. On
or before the thirty-first (31st) day of July, the city council
shall adopt the budget with revisions, if any, by the affirm-
ative votes of at least the majority of its members. Upon
final adoption, the budget shall be in effect for the ensuing
year. Between the first (let) day of July and any subsequent
date on which the budget is adopted, the several offices,
departments and divisions shall be authorized to expend, each
calendar month subject to the controls established in other
sections of this charter, amounts of money equal to the ex-
penditures of each such office, department or division during
the preceding year.
The budget adopted by the city council shall provide
for the support of public recreation programs at least the
equivalent of six cents (6~) on each one hundred dollars ($100)
of the assessed value of taxable property in the city on the
legal assessment date for the previous fiscal year.

A copy of the adopted budget, certified to by the
clerk of the council, shall be filed with the director of
finance and a further copy shall be placed, and shall remain
on file, in the office of the clerk of the council where it
shall be available for inspection. The budget so certified
shall be reproduced and copies made available for the use of
all officers, offices, departments, and other agencies of the
city and for the use of civic organizations.
