ORDINANCE NO. NS-1473
AN ORDINANCE OF THE CITY OF SANTA ANA
CALLING AND GIVING NOTICE OF THE HOLDING
OF A SPECIAL MUNICIPAL ELECTION TO BE
HELD IN SAID CITY ON TUESDAY, THE THIRD
DAY OF APRIL 1979, FOR THE SUBMISSION TO
THE QUALIFIED ELECTORS OF SAID CITY OF A
CERTAIN MEASURE RELATING TO R~VENUE AND
TAXATION; AND REPEALING ORDINANCE NS-1472.
WHEREAS, under the provisions of the Charter of the
City of Santa Aha, California, a regular general municipal
election shall be held on the 3rd day of April, 1979, for the
election of three (3) members of the City Council of said
City for the full term of four years; and
WHEREAS, the City Council of the City of Santa Ana
also desires to submit to the qualified electors of said City
at said election the measure relating to the proposed Charter
amendment hereinafter set forth;
NOWt THEREFORE, THE CITY COUNCIL OF THE CITY OF
SANTA ANA, CALIFORNIA DOES ORDAIN AS FOLLOWS:
SECTION 1: That pursuant to the requirements of
the Charter of the City of Santa Ana, there shall be, and
there is hereby called and ordered held in the City of Santa
Aha, County of Orange, State of California, on Tuesday, the
3rd day of April, 1979, a special municipal election of the
qualified electors of said City for the purpose of submitting
to the qualified electors of said City at said special munici-
pal election the following question, to wit:
REVENUE AND TAXATION. Shall the
Charter be amended to revise the
budget adoption procedure by pro-
hibiting yearly operating and
capital budget growth greater
than 5% and salary, wages and
fringe benefits greater than 70%
of said budget, without a vote
of the electors?

A cross (+) placed in the voting square after the
word "YES" in the manner hereinabefore provided shall be
counted in favor of the adoption of the question or prop-
osition. A cross (+) placed in the voting square after the
word "NO" in the manner hereinbefore provided shall be counted
against the adoption of the question or proposition.
SECTION 2: That the special election be combined
with the general election and be held in the City of Santa Ana
on April 3, 1979, for the purpose of submitting to the qualified
voters of said City the question of whether the Charter of the
City of Santa Aha should be amended by adding a section, to be
numbered 607.5~'which said section shall read as set forth in
Exhibit A, attached hereto and made a part hereof.

SECTION 3: That on the ballot to be used at said
special election, in addition to other matters required by
law, there shall be printed substantially the question as
stated in section 1 hereinabove.
SECTION 4: That the proposal pursuant to Exhibit A
hereof shall be designated on the ballot by a letter, pursu-
ant to Section 10219 of the Elections Code of the State of
California.
SECTION 5: That in all particulars not recited in
this ordinance, said election shall be held and conducted as
provided by law for holding municipal elections in said City.
SECTION 6: That notice of the time and place of
holding said election is hereby given and the Clerk of the
Council is hereby authorized, instructed and directed to
give such further or additional notice of said election in
time, form and manner as required by law.
SECTION 7: That ordinance No. NS-1472 is hereby
repealed.

EXHIBIT A
CHARTER OF THE CITY OF SANTA ANA
Sec. 607.5 Same - Prohibitions
The budget adopted by the city council shall not
exceed the previous year's operating and capital budgets by
more than five percent (5%), and the total budget expenditure
for officers' and employees' wages, salaries and fringe
benefits shall not be greater than seventy percent (70%) of
the operating and capital budgets, without an affirmative
vote of the electors. No amendment or supplement to the
budget pursuant to Section 609 of this article shall exceed
the amounts set forth herein without an affirmative vote
of the electors.
