ORDINANCE NO. NS-1485
AN ORDINANCE OF THE CITY OF SANTA ANA ADDING
SECTION 10-176 TO THE SANTA ANA MUNICIPAL CODE
RELATING TO THE POSSESSION OF FIREARMS AND
AMMUNITION BY A MINOR AND FURNISHING FIREARMS
OR AMMUNITION TO A MINOR
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN
AS FOLLOWS:
SECTION 1: The Santa Ana Municipal Code is hereby
amended by adding a section, to be numbered 10-176, which
said section reads as follows:
Sec. 10-176. Possession of firearms or ammunition by
a minor.
(a) No minor shall possess any firearm or
ammunition in a public place.
(b) No person shall sell, exchange, give or
loan, or cause or permit to be sold, exchanged,
given or loaned, any firearm or ammunition to any
person under the age of eighteen (18) years.
(c) For the purpose of this section, the
term firearm means any weapon which will or is
designed to or may readily be converted to expel
a projectile by the action of an explosive.
(d) For the purpose of this section, the
term ammunition means any unexpended cartridge
or shell, consisting of a case which holds a
charge of powder and a bullet or shot, or any de-
vice containing any explosive designed and in-
tended for use in any firearm, or any device
containing any explosive.
(e) Nothing in this section shall prohibit
the the possession of any firearm by a minor at
a bona fide firing range or in an automobile ve-
hicle while enroute to or from hunting any game
animal that may be legally hunted under the pro-
visions of the Fish and Game Code, provided
said minor has the written permission of his
parent or guardian to have such firearm or is
accompanied by his parent or guardian while he
has such firearm in his possession.
SECTION 2: If any section, subsection, sentence,
clause, phrase or portion of this ordinance is for any
reason held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such
decision shall not affect the validity of the remaining
portions of this ordinance. The City Council of the City of
Santa Ana hereby declares that it would have adopted this
ordinance and each section, subsection, sentence, clause,

phrase or portions thereof, irrespective of the fact that
any one or more sections, subsections, sentences, clauses,
phrases or portions be declared invalid or unconstitutional.
SECTION 3: Neither the adoption of this ordinance nor
the repeal hereby of any ordinance shall in any manner
affect the prosecution for violation of ordinances, which
violations were committed prior to the effective date
hereof, nor be construed as affecting any of the provisions
of such ordinance relating to the collection of any such
license or penalty or the penal provisions applicable to any
violation thereof, nor to affect the validity of any bond or
cash deposit in lieu thereof, required to be posted, filed
or deposited pursuant to any ordinance and all rights and
obligations thereunder appertaining shall continue in full
force and effect.
