ORDINANCE NO. NS-1488
AN ORDINANCE OF THE CITY OF SANTA ANA
AMENDING CHAPTER 36, DIVISION 2 ARTICLES
VII AND VII-A, OF THE SANTA ANA MUNICIPAL
CODE TO ESTABLISH INCREASED AND DECREASED
PRIMA FACIE SPEED LIMITS UPON CERTAIN
STREETS AND PORTIONS OF STREETS IN THE
CITY OF SANTA ANA.
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES
ORDAIN AS FOLLOWS:

SECTION 1: That Article VII of Division 2,
36 of the Santa Ana Municipal Code is hereby amended
as follows:
ARTICLE VII. INCREASED PRIMA FACIE SPEED LIMITS
The City Council of the City of Santa Ana hereby
finds and determines, upon the basis of engineering and
traffic surveys made on the dates hereinafter in this
Article VII specified, that a speed greater than twenty-five
(25) miles per hour would facilitate the orderly movement of
vehicular traffic and would be reasonable and safe upon the
streets and portions of streets hereinafter specified, which
otherwise would be subject to a prima facie limit of twenty-
five (25) miles per hour, and does hereby determine and
declare prima facie speed limits upon such streets and
portions of streets as are hereinafter respectively
specified. The prima facie speed limits hereinafter
specified shall be effective, respectively, when appropriate
signs giving notice thereof are erected upon the streets and
portions of streets hereinafter specified. The provisions of
this Article shall not apply in respect to any twenty-five
(25) miles per hour prima facie speed limit which is
applicable when passing a school or the grounds thereof.

SECTION 2: That Article VII.A of Division 2, Chapter
36 of the Santa Ana Municipal Code is hereby amended to read
as follows:
ARTICLE VII.A.
DECREASED PRIMA FACIE SPEED LIMITS
The City Council of the City of Santa Ana hereby
finds and determines, upon the basis of engineering and
traffic surveys made on the dates hereinafter in this
Article VII.A specified, that the prima facie speed limit of
fifty-five (55) miles per hour is more than is reasonable or
safe upon the streets and portions of streets hereinafter
specified where the limit of fifty-five (55) miles per hour
is applicable, and does hereby determine and declare prima
facie speed limits upon such streets and portions of streets
as are hereinafter respectively specified, which said prima
facie speed limits are found most appropriate to facilitate
the orderly movement of traffic and are reasonable and safe.
The prima facie speed limits hereinafter specified shall be
effective, respectively, when appropriate signs giving
notice thereof are erect upon the street and portions of
streets hereinafter specified. Said prima facie speed limits
are the following:

SECTION 3: If any section, subsection, sentence,
clause, phrase or portion of this ordinance is for any
reason held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such
decision shall not affect the validity of the remaining
portions of this ordinance. The City Council of the City of
Santa Ana hereby declares that it would have adopted this
ordinance and each section, subsection, sentence, clause,
phrase or portion thereof irrespective of the fact that any
one or more sections, subsections, sentences, clauses,
phrases or portions be declared invalid or unconstitutional.
SECTION 4: Neither the adoption of this ordinance
nor the repeal hereby of any ordinance shall in any manner
affect the prosecution for violation of ordinances, which
violations were committed prior to the effective date
hereof, nor be construed as affecting any of the provisions
of such ordinance relating to the collection of any such
license or penalty or the penal provisions applicable to any
violation thereof, nor to affect the validity of any bond or
cash deposit in lieu thereof, required to be posted, filed
or deposited pursuant to any ordinance and all rights and
obligations thereunder appertaining shall continue in full
force and effect.
