ORDINANCE NO. NS-1490
AN ORDINANCE OF THE CITY OF SANTA ANA
ADDING DIVISION 28 TO ARTICLE III OF
CHAPTER 41 OF THE SANTA ANA MUNICIPAL
CODE TO PROVIDE ZONING REGULATIONS FOR
A NEW USE DISTRICT SUFFIX TO BE KNOWN
AS THE X-SUFFIX, AND REZONING THE
MAJOR PORTION OF THE PROPERTY LOCATED
WITHIN THAT AREA OF THE CITY OF SANTA
ANA KNOWN AS THE LOGAN AREA FROM THE
M2 (HEAVY INDUSTRIAL) DISTRICT, PARTLY
TO THE R2-X (MULTIPLE FAMILY RESIDENCE,
X-SUFFIX) DISTRICT, AND PARTLY TO THE
M2-X (HEAVY INDUSTRIAL, X-SUFFIX)
DISTRICT, AMD REZONING CERTAIN PROPERTY
LOCATED AT THE SOUTHEAST CORNER OF
WASHINGTON AVENUE AND CUSTER STREET
FROM THE M2 (HEAVY INDUSTRIAL) DISTRICT
TO THE C2 (GENERAL COMMERCIAL) DISTRICT,
AND AMENDING SECTIONAL DISTRICT
MAP NO. 7-5-9.
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES
ORDAIN AS FOLLOWS:
SECTION 1: That the Santa Ana Municipal Code
is hereby amended by adding a Division, to be numbered 28,
to Article III of Chapter 41 thereof, consisting of sections
numbered 41-595 through 41-599.1, which said Division reads
as follows:
DIVISION 28. X-SUFFIX
Sec. 41-495. Purpose and application.
The purpose of the X-Suffix designation, when
added to a base zone district designation, is to provide
zoning regulations for an area of the City which has developed
as a mixture of residential and industrial uses due to
historical, cultural, and economic reasons, in a manner
which will promote the preservation and enhancement of both
homes and industrial businesses in near proximity to one
another, while allowing for orderly change. Property
within any district to which the X-Suffix is added is subject
to the regulations contained in this Division.
Sec. 41-496. Uses permitted.
(a) Any use which is listed as permitted without the
requirement of a conditional use permit in the base zone to
which the X-Suffix is added shall likewise be permitted
without the requirement of a conditional use permit when the
X-Suffix is added to such district designation.
(b) Unless unconditionally permitted pursuant to
subsection (a) hereinabove, any use which is listed as
permitted, with or without the requirement of a conditional
use permit, in either the R2 District or the M2 District, is
permitted in a district to which the X-Suffix has been added
subject to the issuance of an approved conditional use
permit as prescribed in Article V of this Chapter.

Sec. 41-497.
Building height, yard, and off-
street parking requirements.
Except as may otherwise be specified in this
Division, property used for the uses permitted in R2 or M2
districts shall conform to the building height, yard, and
off-street parking requirements made applicable to such uses
by the R2 or M~ district regulations respectively.
Sec. 41-498.
Additional restrictions on height
and setback of industrial buildings
adjacent to residential parcels.
No part of any building used for M~ purposes shall
be constructed within ten (10) feet of a side property line
bordering any parcel used for R2 purposes, nor shall any
part of any such building within twenty five (25) feet of
such a property line exceed a height of twenty (20) feet.
Sec. 41-499. Walls and fences.
(a) No parcel used for R2 purposes shall be
converted to any M2 use unless a sound-attenuated solid wall
or fence, at least six feet high from highest finished
grade, is constructed along the property line to the extent
such parcel is contiguous to any other parcel used for R2
purposes. No such wall or part thereof shall thereafter be
removed so long as the contiguous parcel continues to be
used for R2 purposes.
(b) No parcel used for M2 purposes shall be
converted to any R2 use unless a sound-attenuated solid wall
or fence; at least six feet high from highest finished
grade, is constructed along the property line to the extent
such parcel is contiguous to any other parcel used for Ma
purposes. No such wall or part thereof shall thereafter be
removed so long as the contiguous parcel continues to be
used for M1 purposes.
SECTION 2: That the real property situated in
the City of Santa Aha, County of Orange, State of California,
described in Exhibit A, attached hereto and incorporated
herein as though fully set forth, which real property comprises
a portion of the parcels in the part of the City of Santa
Aha generally known as the Logan Area, is hereby reclassified
from the M2 (Heavy Industrial) District to the R2-X (Multiple
Family Residence, X-Suffix) District.
SECTION 3: That the real property situated in
the City of Santa Ana, County of Orange, State of California,
described in Exhibit B, attached hereto and incorporated
herein as though fully set forth, which real property comprises
a portion of the parcels in the part of the City of Santa
Ana generally known as the Logan Area, is hereby reclassified
from the M2 (Heavy Industrial) District to to M2-X (~eavy
Industrial, X-Suffix) District.
SECTION 4: That the real property situated in
the City of Santa Ana, County of Orange, State of California,
generally located at the southeast corner of Washington
Avenue and Custer Street, and more specifically described in
Exhibit C attached hereto and incorporated herein as though
fully set forth, is hereby reclassified from the M2 (Heavy
Industrial) District to the C2 (General Commercial) District.

SECTION 5: That Sectional District Map No. 7-
5-9 is hereby amended to show the reclassifications made in
sections 2, 3 and 4 hereinabove.
SECTION 6: In adopting regulations for the X-
Suffix designation and in reclassifying real property from
the M2 !Heavy Industrial) District to the R2-X (Multiple
Family Residence X-Suffix) District, the M2-X (Heavy Industrial,
X-Suffix) District, and the C2 (General Commercial) District,
as set forth in this ordinance, the City Council adopts the
following findings of fact:
1. That prior to the adoption of this ordinance
the Council has reviewed and considered the information
contained in the final Environmental Impact Report for the
project designated "Logan Neighborhood: Amendments to the
General Plan, Zoning Ordinances, and a Specific Street
Alignment" and does hereby approve and certify said Environmental
Impact Report as having been completed in compliance with
the California Environmental Quality Act and the State EIR
Guidelines.
2. That the said Environmental Impact Report
does not identify any significant effects on he environment
arising from this ordinance within the meaning of the California
Environmental Quality Act, in that this ordinance will not
cause any substantial, or potentially substantial, adverse
change in any of the physical conditions within the Logan
Area and its surroundings including land, air, water, minerals,
flora, fauna, ambient noise, and objects of historic or
aesthetic significance. Rather, the effect of this ordinance
will be to preserve and enhance the physical environment now
existing within the said area.
3. That the said Environmental Impact Report, in
addition to analysis of the environmental concerns prescribed
by the California Environmental Quality Act, also discusses
social, cultural, and economic concerns arising from the
project, as previously directed by this Council.
4. The Planning Conunission has given notice and
duly held a public hearing to consider alterative proposals
for the zoning of the Logan Area.
5. The City Council regularly held a public
hearing on this ordinance on published notice required by
law and does now find that the public necessity, convenience,
and general welfare require that the property described in
this ordinance be reclassified as hereinabove set forth, and
that the new classifications will not be detrimental to
surrounding property.
