ORDINANCE NO. NS-1495
AN ORDINANCE OF THE CITY OF SANTA ANA
PROHIBITING NEW CONSTRUCTION ON PROPERTY
LOCATED IN THE CD (CIVIC DEVELOPMENT) USE
DISTRICT NORTH OF CIVIC CENTER DRIVE AND
WEST OF LOWELL STREET FOR AN INTERIM PERIOD
PENDING REVISION OF THE GENERAL PLAN.
SECTION 1: Except as hereafter provided, no
new construction or major addition or alteration of any
building or structure shall be permitted on any parcel
located within the CD (Civic Development) Use District north
of Civic Center Drive and west of Lowell Street, and no
building permit, conditional use permit, variance, or other
entitlement of development shall be issued for any such
purpose.
SECTION 2: This ordinance shall not apply to
minor additions or alterations to existing buildings or structures,
not exceeding Five Thousand Dollars ($5,000.00) in value,
nor to any construction or alteration necessary for the
public health or safety as determined by the issuing authority.
SECTION 3: This ordinance shall be effective
for a period terminating two (2) months after the date of
adoption unless extended, repealed, or modified by ordinance
adopted by this Council.
SECTION 4: This Council finds that this ordinance
is required for the following reasons:
(a) That area north of Civic Center Drive and
west of Lowell Street which is currently included within the
CD (Civic Development) Use District is currently designated
on the Land Use Element of the General Plan of the City of
Santa Ana as planned for High Density Residential Development.
(b) The City Council of the City of Santa Ana
contemplates revising the said General Plan designation to
provide for ultimate planned development more appropriate
for the objectives of promoting desirable development of the
Civic Center area and creating a viable buffer between the
said Civic Center area and residential properties to the north.
(c) Unless prohibited during the period of review
and study preliminary to such revision of the General Plan,
development may occur which is in conflict with such General
Plan revision as finally adopted.
