NS-1538 AN EMERGENCY ORDINANCE OF THE CITY OF SANTA ANA ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN THE SAID CITY ON NOVEMBER 4, 1980, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF THE SAID CITY A PROPOSAL TO AUTHORIZE THE ISSUANCE OF GENERAL OBLIGATION BONDS FOR THE PURPOSE OF FINANCING CAPITAL IMPROVEMENTS, AND STATING THE REASONS FOR ITS URGENCY. WHEREAS, the City Council of the Council of the City of Samta Ana desires that a special municipal election be held on November 4, 1980, for the purpose of submitting a proposal to authorize the issuance of general obligation bonds for the purpose of financing capital improvements to the qualified voters of said City; and WHEREAS, the City Council is requesting the Board of Supervisors of Orange County to order the consolidation of the said special municipal election with the statewide general election to be held on the same date; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That a special election be held and the same is hereby called to be held, in the City of Santa Ana on November 4, 1980, for the purpose of submitting to the qualified voters of said city the proposal hereinafter set forth. SECTION 2: That on the ballot to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: If permitted by amendment to Article XIII A of the California constitution, shall the City Council of the City of Santa Ana be authorized to issue general obligation bonds in a principal amount not to exceed $10,000,000 for tke purpose of financing capital improvements as permitted by such amendment} : YES : : : NO : : SECTION 3: That the above said proposal shall be designated on the ballot by a letter, pursuant to Section 10219 of the Elections Code of the State of California. SECTION 4: That the said special municipal election shall be conducted in accordance with the Elections Code of the State of California, and the Clerk of the Council is hereby authorized and directed to take all actions necessary or appropriate with respect thereto, except to the extent such actions may be undertaken by the Registrar of Voters of the County of Orange upon consolidation of the said special municipal election with the statewide general election. NS-1538 PAGE TW~ SECTION 5: That notice of the time and place of holding said special municipal election is hereby given, and the Clerk of the Council is hereby authorized and directed to give such additional notice thereof as required by law. SECTION 6: This Council finds that this ordinance is urgently required as an emergency ordinance for the immediate preservation of the public peace, health and safety for the following reasons: Capital improvements are urgently needed in the City to alleviate problems of traffic congestion and inadequate sewer and storm-water drainage. The cost of the construction of needed improvements can be minimized by prompt action to start construction before labor and material costs escalate. Issuance of general obligation bonds of the City provides the best possible method of financing such necessary construction promptly. In order for such bond issue to be approved by the electorate at the November 4, 1980 election, this ordinance, calling for a special municipal election on such date, must be adopted as an emergency ordinance. THEREPORE, the City Council declares that this ordinance shall take effect, and be adopted, as an emergency measure and is to be effective from the date of adoption as set forth in the Charter of the City of Santa Ana.
