ORDINANCE NO. NS- 1614
AN EMERGENCY ORDINANCE OF THE CITY OF SANTA
ANA PROHIBITING ISSUANCE OF PERMITS TO ENGAGE
IN THE BUSINESS OF GAMES OF BILLIARDS OR POOL
FOR PROFIT FOR AN INTERIM PERIOD PENDING STUDY
AND ENACTMENT OF APPROPRIATE ORDINANCES
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES
ORDAIN AS FOLLOWS:
SECTION 1: Except as hereinafter provided, the
issuance of permits for the conduct of businesses where
games of billiards or pool are being operated for profit is
hereby prohibited during the effective period of this ordinance.
SECTION 2: This ordinance shall be effective for
a period of four (4) months commencing on the date of adoption
unless extended, repealed or modified by ordinance adopted
by this Council.
SECTION 3: This Council finds that this ordinance
is urgently required as an emergency ordinance for the immediate
preservation of the public peace, health and safety for the
following reasons:
(a) An ordinance is presently being prepared to
require permission from the City of Santa Ana to operate an
establishment wherein billiard or pool tables are being
operated for profit; and
(b) The conduct of a business wherein billiard or
pool tables are being operated for profit ("said business")
often creates conditions which are socially unhealthful and
not in the best interests of the community; and
(c) The conduct of said business contributes to
criminal or anti-social behavior such as loitering, malicious
mischief, disturbing the peace and felonious behavior; and
(d) Unless prohibited during the period of prep-
aration of the licensing ordinance for said business, such
use of property is likely to be initiated in conflict with
such ordinance as finally enacted.
THEREFORE, the City Council declares that this
ordinance shall take effect, and be adopted as an emergency
measure and is to be enforced from the date of publication
of title as required by the Charter of the City of Santa
Ana.
