NS-1619 AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING AMENDMENT APPLICATION NO. 867 TO REZONE PROPERTY LOCATED ON THE EAST SIDE OF GRAND AVENUE BETWEEN 6TH AND FRUIT STREETS FROM THE R3 (MEDIUM DENSITY MULTIPLE FAMILY RESIDENCE) DISTRICT TO THE C5 (ARTERIAL COMMERCIAL) DISTRICT AND AMENDING SECTIONAL DISTRICT MAP NO. 8-5-9. WHEREAS, the real property located on the east side of Grand Avenue between 6th and Fruit Streets and more particularly described infra, is located within the R3 (Medium Density Family Residence) District, and WHEREAS, Amendment Application No. 867 has been filed to amend Sectional District Map No. 8-5-9 to rezone such real property to the C5 (Arterial Commercial) District, and WHEREAS, the Planning Commission has given notice of and duly held a public hearing on said Amendment Application and has recommended approval thereof, and WHEREAS, the City Council regularly held a public hearing on the said Amendment Application on published notice required by law and does now find that the public necessity, convenience, and general welfare require that the said property be reclassified as requested in the said Amendment Application, and that the new classification will not be detrimental to the surrounding property, and WHEREAS, prior to taking this action the City Council has reviewed and considered the information contained in Negative Declaration (I.S. No. 81-164), and, on the basis thereof, finds that the project will not have a significant effect on the environment; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN that the real property situated in the City of Santa Ana, County of Orange, State of California, generally located on the east side of Grand Avenue between 6th and Fruit Streets, and more particularly described in Exhibit A, attached hereto and incorporated herein as though fully set forth, is hereby reclassified from the R3 (Medium Density Multiple-Family Residence) District to the C5 (Arterial Commercial) District, and that Sectional District Map No. 8-5-9 is hereby amended to show said reclassification in accordance with Exhibit A.A. 867-A. Beginning at a point ~n the centerline of Grand Avenue, d~stant 186.90 feet Southerly from the Northwest corner of said Lot 91, said corner being the intersection of the centerl~nes o2 Grand Avenue and Depot Street all as shown on sa~ map, thence Easterly 404.80 feet parallel with said centerline of Depot Street to the East line of said West 3.96 acres, thence Southerly 238.60 feet along said East line to the South line of said Lot #1, thence Westerly 404.90 feet to the Southwest corner of said lot, thence Northerly 238.60 feet to the point of beginning.
