NS-]624 AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING SECTION 39-28 OF THE SANTA ANA MUNICIPAL CODE, RELATING TO PROTECTION OF THE PUBLIC WATER SUPPLY. THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Section 39-28 of the Santa Ana Municipal Code, is hereby amended to read as follows: Section 39-~28. Protection of Public Water Supply. (A) State regulations adopted: The regulations of the State Department of Public Health (Title 17, California Administrative Code, Sections 7553-7622, inclusive), as they are now in effect or as they may be amended in the future, insofar as the same are applicable to the protection of the water supply of this City, are hereby adopted, incorporated herein and made a part hereof. (B) Protection of public water su~l~: No water service connection to any premises of a type specified in subsection (G) hereinbelow shall be installed or maintained unless the public water supply is protected as required by said State regulations and this section. (C) Approval: (1) Each backflow preventive device required hereunder shall be approved by the Department prior to installation, and shall be installed by and at the expense of the customer. (2) The Department shall approve backflow preventive devices when the device has received approval by the Foundation for Cross-Connection Control Research of the University of Southern California, and when such device will provide desired service and reliability. (D) Installation: (1) Devices shall be installed at the service connection in an accessible location approved by the Depart- ment. A reduced pressure principle backflow preventive device shall be installed above ground. (2) Where the maximum pressure in the street water main e~fceeds 150 psi, a pressure regulator set at 150 psi or less shall be installed upstream of the backflow preventive device. (3) Backflow preventive devices shall have at least the same cross-sectional area as the water meter. In those instances where it is determined that a continuous water supply is necessary, two sets of backflow preventive devices shall be installed in parallel. Where parallel devices are required, the sum of the cross-sectional areas of the devices shall be at least equivalent to the cross- sectional area of the meter. ORDINANCE NO. NS- 1624 PAGE TWO (E) Maintenance, testing and records: (1) The customer shall test and service such devices at least once a year, shall maintain them in satis- factory operating condition and shall overhaul or replace such devices if they are found to be defective. (2) Records of such tests, service, repairs and overhauls shall be kept by the customer on forms approved by the Department. A copy of such records shall be sent to the Department. (3) Tests shall be conducted and reported in a manner prescribed by, and/or by persons certified or approved by, the Department or any other agency designated by the Department to prescribe test methods or to certify or approve persons to conduct such tests. (F) Approved backflow preventive devices: (1) As designated in Section (G), the standard installation at each service connection to premises or systems requiring an approved backflow preventive device, shall be one of the following types: (a) Approved reduced pressure principle backflow device [hereinafter "RP"]; or (b) Approved double check valve assembly backflow preventive device [hereinafter "DC"] (G) Pr~%ises re~uirin~ approved backflow preventive devices: An approved backflow preventive device of the type specified below shall be the standard installation at each service connection (whether from a fire hydrant, temporary, regular or other water service connection) to the following types of premises or systems: (1) Aircraft and Missile Plants - RP (2) Automotive Plants - RP (3) Auxiliary Water Systems (Interconnected) - RP (4) Auxiliary Water Systems (Not Interconnected) - DC (5) Beverage Bottling Plants - DC (6) Breweries - RP (7) Buildings greater than three (3) stories or greater than thirty-four (34) feet in height from curb level - DC (8) Buildings with house pumps and/or potable water storage tank - DC ORDINANCE NO. NS- 1624 PAGE THREE (9) Buildings with sewage ejectors (inadequate in-plant protection) - RP (10) Buildings with sewage ejectors (adequate in-plant protection) - DC (11) Canneries, Packing Houses and Reduction Plants -RP (12) Car Wash with water reclamation system - RP (13) Centralized Heating and Air Conditioning Plants - RP (14) Chemical Plants - RP (15) Chemically Treated Potable Water Systems - DC (16) Civil Works (facilities not subject to Santa Ana City plumbing inspection) - RP (17) Commercial Laundries - DC (18) Dairies and Cold Storage Plants - DC (19) Dye Works - RP (20) Film Processing Laboratories - RP (21) Fire System witk pun~ and/or storage tank - RP (22) Fire System witk auxiliary supply - RP (23) Food Processing Plants - DC (24) High Schools and Colleges - DC (25) Holding tank disposal stations - RP (26) Hospitals (major complexes) - RP (27) Hospitals, Mortuaries, Medical and Dental Buildings, and Sanitariums - DC (28) Irrigation Systems (premises having separate - such as parks, playgrounds, cemeteries, golf courses, schools, estates, ranches, etc.) - RP (29) Laboratories using toxic materials - RP (30) Manufacturing, Processing and Fabricating Plants using toxic materials - RP (31) Manufacturing, Processing and Fabricating Plants using nontoxic materials - RP (32) Mobile Home Parks - DC (33) Motion Picture Studios - RP (34) Oil and Gas Production Facilities - RP (35) Paper and Paper Production Plants - RP ORDINANCE NO. NS- 1624 PAGE FOUR (36) Plating Plants - RP (37) Radioactive Materials Processing Facilities - RP (38) Restricted, Classified or other Closed Facilities - RP (39) Rubber Plants - RP (40) San~ and Gravel Plants - RP (41) Sewage and Storm Drainage Facilities - RP (42) Waterfront Facilities - RP (43) Any premises where a cross-connection is maintained - RP (44) Any premises where the use of a substance, process water or water supplied by the City is such as to subject the water to deterioration in sanitary quality and to permit its entry into the water system - RP (H) Department modification: In those instances where conditions warrant, the Department may modify the standard installation herein indicated as appropriate to provide a degree of protection commensurate with the degree of hazard. (I) Discontinuance of water service: Service of water to any premises may be discontinued by the Department after notice if a backflow preventive device required by this section is not instal]ed, tested an~ maintained, or if any defect is found in an installed backflow preventive device, or it is found that a backflow preventive device has been removed or bypassed, or if unprotected cross-connections exist on the premises; and service will not be restored until such conditions or defects are corrected. (J) Information requests: Upon request, the Department will provide interested parties with copies of Section 39-28, rules and regulations for the testing and maintenance of devices, and such other advice, information, illustrative sketches, drawings and data as may be necessary to familiarize the customers, engineers, architects and others with Department requirements. SECTION 2: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional. NS- 1624 PAGE FIVE SECTION 3: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such liceDse or penalty or the penal provision applicable to any violatioD thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligatiens thereunder appertaining shall continue in full force and effect.
