NS-1633 AN ORDINANCE OF THE CITY OF SANTA ANA ADDING SECTION 8-163 TO THE SANTA ANA MUNICIPAL CODE, RELATING TO FIRE RE- TARDANT ROOFS THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Section 8-163 is hereby added to the Santa Ana Municipal Code to read as follows: Sec. 8-163 Roofs (Section 1704) Sec. 1704 of the Building Code is amended to read as follows: Sec. 1704(a). Newly Constructed Roofs. Except as provided in Subsection (b) relating to re-roofing, and notwithstanding any other provision of this code and appendix to the contrary, the roof covering of any building hereafter constructed, regardless of type or occupancy classification, shall be of noncombustible or fire-retardant construction as defined and described in Subsection (e) of Section 3203 of this code. (b) Re-Roofing. Unless as otherwise directed by the building official, the re-roofing of any existing building, regardless of type or occupancy classification, may be made of the same materials and/or type of construction as found in the present roof. When, however, because of the age, location or type of construction found in an existing build- ing, the building official determines that the public health and safety necessitates that re-roofing of the building requires materials and/or type of construction different from that found in the present roof, such official may order the use of such different materials and/or type of con- struction in accordance with the following general pro- visions: 1. Ail re-roofing shall be constructed in accordance with the standards set forth in Chapter 32 of the appendix of this code; 2. Such re-roof coverings shall be fire retardant except in Types III, IV and V buildings, where it may be as follows: a. Ordinary roof coverings may be used on build- ings of Group R, Division 3 or Group M Occupancies; b. Ordinary roof coverings may be used on build- ings of Group R, Division 1 Occupancies which are not more than two stories in height and have not more than 3000 square feet of projected roof area and there is a minimum of 10 feet from the extremity of the roof to the property line on all sides except for street fronts; c. Class C roof coverings which comply with U.B.C. Standard No. 32-7 and roofs of No. 1 cedar or redwood shakes and No. 1 shingles constructed in accordance with the requirements of U.B.C. Standard No. 32-14 for Special Purpose Roofs may be used on Group A, Division 3; Group B, Divisions 1 ORDINANCE NO. NS- 1633 PAGE TWO and 2 and Group R, Division 1 Occupancies which are not more than two stories in height and have not more than 6000 square feet of projected roof area and there is a minimum of 10 feet from the extremity of the roof to the property lines on all sides except for street fronts. Skylights shall be constructed as required in Chapter 34. Penthouses shall be constructed as required in Chapter 36. For use of plastics in roofs, see Chapter 52. For Attics; Access and Area, see Section 3205. Roof Drainage, see Section 3207. For SECTION 2: Pursuant to the provisions and authority of Sections 17958.5 and 17958.7 of the Health and Safety Code of the State of California, the City Council of the City of Santa Ana finds, determines and declares that the above- described amendment to Section 1704 of the Uniform Building Code, 1979 Edition, is reasonably necessary for the health, safety and general welfare of the residents of the City of Santa Ana due to the following climatic, geographical and topographical conditions: 1. The City of Santa Ana is geographically located in an area which is subject to periodic extremely high velocity wind conditions; said condition being further accentuated by the topographical features of the hill and canyon areas located easterly of the city; 2. The City of Santa Ana is subject to seasonably high temperatures and dry atmospheric conditions which often occur during times of the high velocity winds as hereinabove described; and 3. Due to the climatic, geographical and topo- graphical conditions hereinabove described, the City of Santa Ana is susceptible to fires which are of particular danger during periods of high winds when fires tend to spread across building roofs where such roofs are not made of noncombustible or fire-retardant construction. SECTION 3: That the City's Director of Planning and Development Services be directed to file a copy of this ordinance with the Department of Housing and Community Development of the State of California. SECTION 4: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the de- cision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 5: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, ORDINANCE NO. NS-1633 PAGE THREE nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
