ORDINANCE NO. NS-1635
AN ORDINANCE OF THE CITY OF SANTA ANA
APPROVING AMENDMENT APPLICATION NO. 872
TO REZONE PROPERTY LOCATED ON THE EAST
SIDE OF TUSTIN AVENUE SOUTH OF SEVENTEENTH
STREET FROM THE LP (LIMITED PROFESSIONAL),
0 (OPEN SPACE), A1 (AGRICULTURAL), AND C 1
(COMMUNITY COMMERCIAL) DISTRICTS TO THE
CD (CIVIC DEVELOPMENT) DISTRICT AND
AMENDING SECTIONAL MAP NO. 9-5-9
WHEREAS, the real property located on the east
side of Tustin Avenue, south of Seventeenth Street and more
particularly described infra, is located in part within the
LP (Limited Professional), 0 (Open Space), A 1
(Agricultural), and C 1 (Community Commercial) Districts,
and
WHEREAS, Amendment Application No. 872 has been
filed to amend Sectional District Map No. 9-5-9 to rezone
such real property to the CD (Civic Development) District,
and
WHEREAS, the Planning Commission has given notice
of and duly held a public hearing on said Amendment
Application and has recommended approval thereof, and
WHEREAS, the City Council regularly held a public
hearing on the said Amendment Application on published
notice required by law and does now find that the public
necessity, convenience, and general welfare require that the
said property be reclassified as requested in the said
Amendment Application, and that the new classification will
not be detrimental to the surrounding property, and
WHEREAS, prior to taking this action the City
Council has reviewed and considered the information
contained in Negative Declaration (I.S. No. 82-18), and, on
the basis thereof, finds that the project will not have a
significant effect on the environment;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
SANTA ANA DOES ORDAIN that the real property situated in the
City of Santa Ana, County of Orange, State of California
generally located on the east side of Tustin Avenue, south
of Seventeenth Street, and more particularly described in
Exhibit A, attached hereto and incorporated herein as though
fully set forth, excepting therefrom such portion thereof as
is currently included within the CD (Civic Development)
District, is hereby reclassified from the LP (Limited
Professional), O (Open Space), A 1 (Agricultural), and C 1
(Community Commercial) Districts to the CD (Civic
Development) District, and that Sectional District Map No.
5-9 is hereby amended to show said reclassification in
accordance with Exhibit AA. 872-A.

EXHIBIT A
Ail that real property consisting of the following
parcels:
Parcel 1: That portion of Lot 2 of the Subdivision of the
Felipe Yorba Tract, as shown on map recorded in Book 4, page
206 of Miscellaneous Records, in the office of the County
Recorder of Los Angeles County, as described in deed to the
State of California (State Parcel Al90) recorded August 24,
1956 in Book 3622, page 516 of Official Records in the
office of the County Recorder of Orange County more
particularly described as follows:
Beginning at a point in the Northerly line of the
parcel of land so described, distant thereon S89" 22' 45" E,
35.00 feet from the Northwest corner of said parcel of land;
thence S 8" 30' 39" W, 252.39 feet to a point in the
Westerly line of said parcel of land, distant thereon
Southerly 250.00 feet from said Northwest corner: thence
along said Westerly line S 0" 32' 23" W, 492.50 feet to the
Southwest corner of said parcel of land; thence along the
Southerly line of said parcel of land S 89° 22' 45" E, 11.87
feet to the Northeasterly corner of that certain parcel of
land described in Director's Deed D-A188.1 recorded November
16, 1964 in Book 7303, page 23, of Official Records in the
office of the County Recorder of said Orange County; thence
along the Northerly prolongation of the Easterly line of
last said certain parcel of land N 5" 10' 14" E, 744.85 feet
to the Northerly line of first said parcel of land so
described; thence along said Northerly line, N 89" 22' 45"
W, 37.01 feet to the point of beginning.
EXCEPTING THEREFROM that portion of the hereinabove
described parcel of land lying Southerly of the following
described line:
Beginning at a point in that course hereinabove
described as S 0° 32' 23" W, 492.50 feet, distant thereon S
0" 32' 23" W, 102.66 feet from the Northerly terminus
thereof; thence S 89° 22' 45" E, 43.45 feet to a point in
that course hereinabove described as N 5" 10' 14" E, 744.85
feet, distant thereon S 5° 10' 14" W, 353.77 feet from the
Northerly terminus thereof.
There shall be no abutter's rights of access
appurtenant to the above described real property in and to
the adjacent State freeway.
Parcel 2: Beginning at the point of the northwesterly
corner of Parcel 1 of Parcel Map 79-899, as recorded in Book
147, Pages 26 and 27 of Parcel Maps, county of Orange;
thence, S.00"42'07" W.; a distance of 138.46 feet to the
northerly line of Lot 3 of the Felipe Yorba Tract; thence,
westerly along said line S. 89°42'29'' W.; a distance of
131.98 feet to the east line of the west one half of Lot 4
of the Felipe Yorba Tract; thence, northerly along said line
N. 00~18'09 W.; a distance of 137.81 feet to the northerly
line of Parcel 1, Parcel Map 79-899; thence, easterly along
said line N. 89~26'40'' E.; a distance of 134.41 feet to the
point of beginning.
Parcel 3: Beginning at the northwest corner of the
easterl~"'10 acres of Lot 2, Felipe Yorba Tract, as shown on
Parcel Map No. 79-899, as recorded in Book 147, Pages 26 and
27 of Parcel Maps, county of Orange; thence, easterly along
the northerly line of said Lot 2, S 89°55'15'' E., a distance
of 69.08 feet more or less to the westerly line of the state
highway acquisition for the Newport Freeway, as recorded in
the documents of Orange County in Book 3622, Page 516;
thence, southerly along said westerly line S. 04"23'54" W.;
a distance of 353.81 feet, thence, N. 89°55'15'' W.; a
distance of 40.77 feet more or less to the southeasterly
corner of Parcel 2, of a Parcel Map No. 79-899; thence, N.
00°11'30'' W., along the westerly line of the easterly 10
acres of Lot 2, Felipe Yorba Tract, a distance of 352.81
feet to the point of beginning.
