NS-1635 AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING AMENDMENT APPLICATION NO. 872 TO REZONE PROPERTY LOCATED ON THE EAST SIDE OF TUSTIN AVENUE SOUTH OF SEVENTEENTH STREET FROM THE LP (LIMITED PROFESSIONAL), 0 (OPEN SPACE), A1 (AGRICULTURAL), AND C 1 (COMMUNITY COMMERCIAL) DISTRICTS TO THE CD (CIVIC DEVELOPMENT) DISTRICT AND AMENDING SECTIONAL MAP NO. 9-5-9 WHEREAS, the real property located on the east side of Tustin Avenue, south of Seventeenth Street and more particularly described infra, is located in part within the LP (Limited Professional), 0 (Open Space), A 1 (Agricultural), and C 1 (Community Commercial) Districts, and WHEREAS, Amendment Application No. 872 has been filed to amend Sectional District Map No. 9-5-9 to rezone such real property to the CD (Civic Development) District, and WHEREAS, the Planning Commission has given notice of and duly held a public hearing on said Amendment Application and has recommended approval thereof, and WHEREAS, the City Council regularly held a public hearing on the said Amendment Application on published notice required by law and does now find that the public necessity, convenience, and general welfare require that the said property be reclassified as requested in the said Amendment Application, and that the new classification will not be detrimental to the surrounding property, and WHEREAS, prior to taking this action the City Council has reviewed and considered the information contained in Negative Declaration (I.S. No. 82-18), and, on the basis thereof, finds that the project will not have a significant effect on the environment; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN that the real property situated in the City of Santa Ana, County of Orange, State of California generally located on the east side of Tustin Avenue, south of Seventeenth Street, and more particularly described in Exhibit A, attached hereto and incorporated herein as though fully set forth, excepting therefrom such portion thereof as is currently included within the CD (Civic Development) District, is hereby reclassified from the LP (Limited Professional), O (Open Space), A 1 (Agricultural), and C 1 (Community Commercial) Districts to the CD (Civic Development) District, and that Sectional District Map No. 5-9 is hereby amended to show said reclassification in accordance with Exhibit AA. 872-A.
