NS-1683 AN ORDINANCE OF THE CITY OF SANTA ANA ADDING SECTIONS 33-5, 33-6, 33-7, AND 33-8 TO THE SANTA ANA MUNICIPAL CODE AND AMENDING SECTION 34-66 THEREOF, TO PROVIDE PROCEDURES FOR THE NAMING AND RENAMING OF STREETS AND OTHER PUBLIC FACILITIES THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That the Santa Ana Municipal Code amended by adding a section, to be numbered 33-5, section reads as follows: is hereby which said Sec. 33-5 Names of streets and other public facilities Submittal of requests. Requests for the naming or renaming of streets, public buildings, parks or recreational facilities owned or controlled by the city, except proposals initiated by the city council or the planning commission, shall be submitted in writing to the director of planning and development serv ices. SECTION 2: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 33-6, which said section reads as follows: See. 33-6. Same - Decision by planning commission Ail requests for the naming or renaming of any public street, public building, park or recreational facility shall be referred to the planning commission for determination. The planning commission may approve the name proposed, approve it with modifications or approve a different name. In reaching its decision the planning commission shall give consideration to the following policy guidelines: (a) Any street which is a continuation of, or approximately the continuation of, any existing street should be given the same name as the already existing street, in the absence of other overriding considerations. (b) Streets and other public facilities should not be given names which would cause confusion with other streets or public facilities. ORDINANCE NO. NS- 1683 PAGE TWO (C) Names which achieve any of the following purposes should be promoted: (1) A name which serves to identify the location of the subject by reference to distinct geographic, environmental or development features in the immediate area. (2) A name which references the history of the subject site or its immediate area. (3) A name which identifies a person or family which made an extraordinary donation of land or funds to promote the construction or improvement of the subject public facility. (4) A name which recognizes a person or family who made a distinct, significant contribution to the well-being of the city, including past mayors, council members, board or commission members, officers or employees of the city, but not anyone who currently holds any such position. SECTION 3: That the Santa Ana Municipal amended by adding a section, to be numbered secton reads as follows: Code is hereby 33-7, which said Sec. 33-7 Same - public hearings. (a) Prior to any change of name of an existing street, if the renaming would change the street address of one or more occupants of abutting property, the planning commission shall hold a public hearing on the proposed street renaming. The director of planning and development services shall endeavor to mail or deliver written notice of the proposed renaming to all such affected occupants at least ten (10) days prior to the date of the hearing, but the failure of any such affected occupant to receive such notice shall not invalidate any determination to change the name of the street made pursuant to this Article. (b) In cases other than those governed by subsection (a), the director of planning and development services, the planning commission, or the city council may set a public hearing on any request for the naming or renaming of any street or other facility, subject to such notice as they deem appropriate. ORDINANCE NO. NS- 1683 PAGE THREE SECTION 4: That the Santa Ana Municipal Code amended by adding a section, to be numbered 33-8, section reads as follows: is hereby which said Sec. 33-8. Review by the Council. (a) Following the decision of the planning commission under section 33-6, the director of planning and development services shall prepare a report of the commission's action, summarizing the public input, if any, and the reasons for the commission's decision. Such report shall be submitted to the city council at its first regular meeting occurring at least ten (10) days after the commission's action. The city council may affirm the commission's decision, remand the matter back to the planning commission for further consideration, or make its own decision on the matter. (b) Any person who desires to express opposition to the planning commission's decision may address the council prior to the council's action under this section or may submit such opposition in writing prior to such time. The director of planning and development services shall provide notification of the date and approximate time of the council's action to any person who requests such notification. SECTION 5: That section 34-66 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 34-66. Street names. In the case of any subdivision in which the dedication and/or improvement of a new street or extension of a street (but excluding widenings of existing streets) is proposed or required, the proposed name of such street, as designated on the tentative map or otherwise, shall be submitted for approval pursuant to sections 33-5 through 33- 9 of this Code. The name of the street as designated on the parcel map or final map shall conform to the name approved pursuant to said sections, notwithstanding any other designation on a previously approved tentative map. SECTION 6: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court or competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ORDINANCE NO. NS- 1683 PAGE FOUR ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional. SECTION 7: Resolution No. 80-5 of this Council, adopted January 7, 1980, establishing a policy for the naming of streets, public buildings, parks and recreational facilities, is hereby repealed, and the "Facility Naming Committee," as previously established by this Council, is hereby abolished.
