REL:adg 3/1/84 4/20/84 6/5/84 AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING SECTIONS 41-260, 41-261, 41-262, 41-263, 41-264, 41-265, 41-266, 41-267, 41-275, 41-276, 41-278, 41-279, 41-280, 41-281 AND 41-282 OF THE SANTA ANA MUNICIPAL CODE TO REVISE THE DEVELOPMENT STANDARDS FOR THE R3 AND R3H USE DISTRICTS THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Section 41-260 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-260. Minimum gross floor area. The following uses shall be subject to the following minimum square feet of gross floor area per unit, exclusive of garages, carports and open porches: (a) Bachelor unit: Four hundred (400) square feet. (b) One-bedroom unit: Five hundred fifty (550) square feet. (c) Two-or-more-bedroom unit: Seven hundred fifty (750) square feet Other than in bachelor units, any area which is eighty (80) square feet or larger and which has a closet and/or a bathroom shall be considered a bedroom. SECTION 2: That Section 41-261 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-261. Building height. No building or structure shall exceed the height limit specified in Section 41-602 of this Chapter. No mechanical or other appurtenances on a building or structure shall ex- tend more than five (5) feet above such height limit. SECTION 3: That Section 41-262 of the Santa Ana Municipal Code is hereby amended to read as follows: ORDINANCE NO. NS-1726 PAGE TWO Sec. 41-262. Minimum lot area per dwelling unit. The proportion of dwelling units to lot area shall not exceed the following standards: (a) Bachelor and one-bedroom units: Not less than one thousand (1,000) square feet of lot area per dwelling unit. (b) Two-or-more-bedroom units: Not less than twelve hundred (1,200) square feet of lot area per dwelling unit if the total lot area is twenty-four thousand (24,000) square feet or less. Not less than one thousand three hundred fifty (1,350) square feet of lot area per dwelling unit if the total lot area is more than twenty-four thousand (24,000) square feet, but forty thousand five hundred (40,500) square feet or less. Not less than one thousand five hundred (1,500) square feet of lot area per dwelling unit if the total lot area is more than forty thousand five hundred (40,500) square feet or more. SECTION 4: Code is hereby That Section 41-263 of the Santa Ana Municipal amended to read as follows: Sec. 41-263. Front yard. There shall be a front yard of not less than fifteen (15) feet, plus one additional foot for each foot by which the building's height exceeds thirty (30) feet. SECTION 5: That Section 41-264 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-264. Side yard. (a) There shall be a side yard of not less than six (6) feet plus an additional one-half of ORDINANCE NO. NS-1726 PAGE THREE (b) one foot for each foot by which the build- ing's height exceeds thirty (30) feet. On corner lots the side yard on the street side shall be not less than (10) feet, plus an additional one-half of one foot for each foot by which the building's height exceeds thirty (30) feet. SECTION 6: That Section 41-265 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-265. Rear yard. There shall be a rear yard of not less than ten (10) feet, plus an additional one-half of one foot for each foot by which the building's height exceeds thirty (30) feet. SECTION 7: That Section 41-266 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-266. Off-street parking. Off-street parking shall be provided in the manner prescribed in Article IV of this Chapter. A front yard or street-oriented side yard may be used for parking only if such yard is fully landscaped for the entire depth of the minimum required yard measured from the street. SECTION 8: That Section 41-267 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-267. Usable open space. There shall be provided a minimum (a) Two hundred and fifty (250) square feet of usable open space for each dwelling unit, either as private usable open space, or a combination of private and common usable open space. The minimum required front ORDINANCE NO. NS-1726 PAGE FOUR yard and street-oriented side yard and all walkways, driveways, and open or enclosed parking areas shall not be considered open space in the fulfillment of this requirement. (b) Ail dwelling units shall have private usable open areas with the following minimum dimen- sions and areas: (1) When located on open ground, utilized as a patio, terrace, open atrium, or surface of a court, each open area shall have a depth of not less than eight (8) feet and an area of not less than one hundred (100) square feet. (2) When located on a balcony, porch, or deck, each area shall have a depth of not less than six (6) feet and an area of not less than sixty (60) square feet. (c) The remaining required usable open space, not provided as private usable open space, shall be provided in common usable open space. Any area designated as common usable open space shall have dimensions of not less than twenty (20) feet by ten (10) feet and a total area of not less than four hundred (400) square feet. SECTION 9: That Section 41-275 of the Santa Ana Municipal Code is amended to read as follows: Sec. 41-275. Minimum gross floor area per dwelling unit. The following uses shall be subject to the followinG minimum square feet of gross floor area per dwelling unit, exclusive of garages, carports and open porches: ORDINANCE NO. NS-1726 PAGE FIVE (a) Bachelor unit with sleeping room only: Four hundred (400) square feet. (b) One-bedroom unit: Five hundred fifty (550) square feet. (c) Two-or-more-bedroom unit: Seven hundred fifty (750) square feet. Other than in bachelor units, any area which is eighty (80) square feet or larger and which has a closet and/or a bathroom shall be considered a bedroom. SECTION 10: That Section 41-276 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-276. Building height. No building or structure shall exceed the height limit specified in Section 41-602 of this Chapter. No mechanical or other appurtenances on a building or structure shall extend more than five (5) feet above such height limit. SECTION 11: That Section 41-278 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-278. Front yard. SECTION 12: That Section 41-279 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-279. Side yard. (a) There shall be a side yard of not less than six (6) feet, plus an additional one-half of one foot for each foot by which the building's height exceeds thirty (30) feet. (b) On corner lots, the side yard on the street side shall be not less than (10) feet, plus an additional one-half of one foot for each foot by which the building's height exceeds thirty (30) feet. ORDINANCE NO. NS-1726 PAGE SIX SECTION 13: That Section 41-280 of the Santa Ana Municipal Code is amended to read as follows: Sec. 41-280. Rear yard. There shall be a rear yard of not less than ten (10) feet, plus an additional one-half of one foot for each foot by which the building's height exceeds thirty (30) feet. SECTION 14: That Section 41-281 of the Santa Ana Municipal Code is amended to read as follows: Sec. 41-281. Off-street parking. SECTION 16: If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court or competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or uncon- stitutional. NS-1726 PAGE EIGHT SECTION 17: Neither the adoDtion of this Ordinance nor the repeal hereby of any ordinance shall in any manner affect the mSeCution for violation of ordinances, which violations were mitted prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any cash deposit in lieu thereof, re- quired to be posted, filed or deposit pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
