NS- 1745 AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING SECTIONS 6-628 THROUGH 6-630 OF THE SANTA ANA MUNICIPAL CODE WHEREAS, the City Council heretofore adopted Resolution No. 71-64 declaring that there is a need for a housing authority and found that there exists in the City unsanitary and unsafe inhabited dwelling accommodations and a shortage of space and sanitary dwelling accomodations available to persons of low income at rentals they can afford; and WHEREAS, the City Council pursuant to California Health and Safety Code Section 34290 declared itself by Resolution No. 71-64 to be the commissioners of the housing authority; and WHEREAS, the City Council, by Ordinance No. NS- 1358, created a housing commission pursuant to Health and Safety Code Section 34291, providing for the number of members thereof, their terms of office and their qualifi- cations and the method of their appointment; and WHEREAS, the City Council now desires to amend Ordinance No. NS-1358 to delete the provision requiring the appointment of seven (7) members of the housing commission from among the members of the human relations commission of the City of Santa Ana and to provide for appointment, re- moval, vacancies and terms of the members of the housing commission. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Section 6-628 of the Santa Ana Municipal Code is hereby amended to read as follows: Section 6-628. Establishment. The housing commission is hereby created, con- sisting of nine (9) members, including two (2) tenants. ORDINANCE NO. NS- 1745 Page Two SECTION 2: That Section 6-629 of the Santa Aha Municipal Code is hereby amended to read as follows: Section 6-629. Appointment, Removals, Vacancies. The members of the housing commission shall be appointed and may be removed and vacancies filled as pro- vided in Section 901 of the Charter of the City of Santa Aha. SECTION 3: That Section 6-630 of the Santa Aha Municipal Code is hereby amended to read as follows: Section 6-630. Terms of members. The terms of members of the housing commission, except for the tenant commissioners, shall be in accordance with Section 901 of the Charter of the City of Santa Ana. The tenant commissioners shall serve for terms of two years, from the date of their appointments, and their successors shall be tenants. Successors of tenant commissioners shall be appointed for a term of two (2) years. If a tenant commissioner ceases to be a tenant, he shall be disqualified as a commissioner and another tenant shall be appointed to fill the unexpired term. SECTION 4: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more section, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional. SECTION 5: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or ORDINANCE NO. NS- 1745 Page Three penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
