ORDINANCE NO. NS-1751
AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING
SECTION 14-90 OF THE SANTA ANA MUNICIPAL CODE
PERTAINING TO FEES FOR PARAMEDIC SERVICES
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN
AS FOLLOWS:
SECTION 1: That Section 14-90 of the Santa Ana Municipal
Code is hereby amended to read as follows:
Sec. 14-90. Fees for Paramedic Services.
The city may establish and collect fees for trans-
portation of persons in paramedic or other fire department
vehicles owned by the City of Santa Ana to a hospital for
medical care and for services rendered to persons by paramedics
and for services and medical care rendered to persons by para-
medics using City of Santa Ana owned paramedic vehicles or other
City of Santa Ana Fire Department vehicles where the person is
not transported by a city-owned paramedic or other fire depart-
ment vehicle. The city council may establish such fees by
resolution.
The fire chief shall notify the director of finance
following such transportation, medical care, or services, in
writing, of the name and address of the person, date and time
of the transportation, medical care or, services performed, and
such other information as may be required. The director of
finance shall thereafter cause appropriate billings to be made.
Such fees for transportation, medical care and services
shall not be less than the average fees charged by commercial
ambulances for comparable services in the city.
The amount of such fees charged shall be deemed a
debt to the city of the person or persons receiving said services
and, if minors, their parents or guardians. Any person owing
money shall be liable in an action brought in the name of the
city for recovery of such amount, including reasonable attorney
fees.

SECTION 2: The provisions of Section 14-90 of the Santa Ana
Municipal Code as amended by this Ordinance shall apply retro-
actively to June 25, 1984.
SECTION 3: If any section, subsection, sentence, clause,
phrase or portion of this Ordinance is for any reason held to
be invalid or unconstitutional by the decision of any court
or competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this Ordinance. The City
Council of the City of Santa Ana hereby declares that it would
sentence, clause, phrase or portion thereof irrespective of the
fact that any one or more sections, subsections, sentences,
clauses, phrases, or portions be declared invalid or uncon-
stitutional.
SECTION 4: Neither the adoption of this Ordinance nor the
repeal hereby of any ordinance shall in any manner affect the
prosecution for violation of ordinances, which violations were
committed prior to the effective date hereof, nor be construed
as affecting any of the provisions of such ordinance relating
to the collection of any such license or penalty or the penal
provision applicable to any cash deposit in lieu thereof, re-
quired to be posted, filed or deposit pursuant to any ordinance
and all rights and obligations thereunder appertaining shall
.continue in full force and effect.
