NS-1805 AN ORDINANCE OF THE CITY OF SANTA ANA ADDING SECTION 33-10 TO THE SANTA ANA MUNICIPAL CODE TO AUTHORIZE DIRECTIONAL SIGNS IN THE PUBLIC RIGHT-OF-WAY FOR PLACES OF PUBLIC ASSEMBLY THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 33-10, which said section reads as follows: Sec. 33-10. Directional signs for places of public assembly (a) The Executive Director of the Public Services Agency is authorized to provide for the installation in the public right-of-way of signs which provide motorists with direction to places of public assembly, including but not limited to churches and other privately owned or operated places of public assembly, subject to the following conditions: (1) The sign shall be installed by City personnel. (2) Ail costs of construction, installation, main- tenance, repair replacement, relocation, and removal of the sign shall be borne by the organization which owns or operates the facility to which the sign pertains. (3) The sign shall be so located as to avoid any interference with vehicular or pedestrian traffic or the creation of any traffic hazard. (4) Sign installation shall be limited to arterial streets. (5) No more than two (2) signs shall be installed for any single place of public assembly, and no more than one (1) sign for any single such place of public assembly shall be installed on any single street. ORDINANCE NO. NS- 1805 PAGE TWO (6) The place of public assembly to which the sign pertains shall be classified as Group A with an occupancy load of at least 50 persons under the Building Code of the City of Santa Ana. (7) The sign shall comply with the regulations issued by the Executive Director of the Public Services Agency pursuant to subsection (b) of this section. is (b) The Executive Director of the Public Services Agency further authorized to: (1) Issue regulations governing the size, shape, color, materials and location of signs to be installed pursuant to this section and the procedures for applica- tions for such signs. (2) Relocate any sign as necessary to accommodate the public use of the public right-of-way. (3) Remove any sign which n° longer serves the purpose for which it was installed or upon the failure of the responsible organization to pay amounts due to the City pursuant to subsection (a) of this section. (c) Each application for a sign pursuant to this section shall be accompanied by an application fee in an amount estab- lished by resolution of the City Council. SECTION 2: Until such time as otherwise established by resolution of the City Council, the application fee for a directional sign to be installed pursuant to Section 33-10 of the Santa Ana Municipal Code shall be $52.50. SECTION 3: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court or competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would ORDINANCE NO. NS-1805 PAGE THREE have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or uncon- constitutional.
