ORDINANCE NO. NS-1809
AN ORDINANCE OF THE CITY OF SANTA ANA
AMENDING SECTIONS 8-290, 8-301, 8-302,
8-303, 8-307 AND 8-308 OF THE SANTA ANA
MUNICIPAL CODE ADDING SECTIONS 8-313, 8-403,
8-404 AND 8-405 THERETO TO ADOPT THE UNI-
FORM PLUMBING CODE, 1982 EDITION, WITH
AMENDMENTS, BY REFERENCE.
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS
FOLLOWS:
SECTION 1: That section 8-290 of the Santa Ana Municipal Code,
is hereby amended to read as follows:
Sec. 8-290. Adoption by reference.
There is adopted by the city that certain code known as
the International Association of Plumbing and Mechanical officials
Uniform Plumbing Code, 1982 Edition, and the whole thereof,
including the appendices thereto, save and except that portion
entitled "Part 1, Administration" and such portions as are deleted
by the amendments set forth in this article, of which said code
not less than three (3) copies have been and are on file in the
office of the clerk of the council of the city. ~The said code is
adopted and incorporated as fully as if set forth at length herein
as provided for in Section 419 of the Charter of the city, and
subject to all amendments set forth in this article, shall be in
effect within the City of Santa Ana from the effective date of
this ordinance. Any provision of this article amending the
"Plumbing Code" or "Uniform Plumbing Code" shall be construed as
amending the said adopted code, 1982 Edition, including such
provisions enacted prior to the enactment of this ordinance and
not thereafter repealed. The said adopted code, 1982 Edition, as
thus amended, together with all other provisions of this article,
shall be known as the Plumbing Code of the City of Santa Ana.
SECTION 2: That section 8-301 of the Santa Ana Municipal Code
is hereby amended to read as follows:
Sec. 8-301. Administrative authority and assistants.
Whenever the term "administrative authority" is used in
this code, it shall be construed to mean the building official of
the city or his authorized representative.

SECTION 3: That section 8-302 of the Santa Ana Municipal Code
is hereby amended to read as follows:
Sec. 8-302. Assistants.
Whenever the term "assistant" is used in this code it
shall be construed to mean the senior plumbing inspector, plumbing
inspector, or other inspector of the permit and Inspection
Services Department of the city. ~
SECTION 4: That section 8-303 of the Santa Ana Municipal Code
is hereby amended to read as follows:
Sec. 8-303. Department having jurisdiction.
Administration and enforcement of this code shall be the
duty of the permit and Inspection Services Department of the city.
SECTION 5: That section 8-307 of the Santa Ana Municipal Code
is hereby amended, to read as follows:
Sec. 8-307. Violations and penalties.
Any person violating any provision of the plumbing code
shall be punished as provided in section 1-8 of the Santa Ana
Municipal Code, and in addition all procedures for the correction
of illegal conditions shall apply.
Each separate day or any portion thereof during which
any violation of this code occurs or continues shall be deemed to
constitute a separate offense, and upon conviction thereof shall
be punishable as herein provided.
The issuance or granting of a permit or approval of
plans and specifications shall not be deemed or construed to be a
permit for, or an approval of, any violation of any of the
provisions of this code. No permit presuming to give authority
to violate or cancel the provisions of this code shall be valid,
except insofar as the work or use which it authorized is lawful.
The issuance or granting of a permit or approval of
plans shall not prevent the administrative authority from
thereafter requiring the correction of errors in said plans and
specifications or from preventing construction operations being
carried on thereunder when in violation of this code or of any
other ordinance or from revoking any certificate of approval when
issued in error.

Every permit issued by the administrative authority
under the provisions of this code shall expire by limitation and
become null and void, if the work authorized by such permit is not
commenced within one hundred eighty (180) days from the date of
such permit, or if the work authorized by such permit is suspended
or abandoned at any time after the work is commenced for a period
of one hundred eighty (180) days. Before such work can be
recommenced a new permit shall be first obtained so to do, and the
fee therefor shall be one-half (1/2) the amount required for a new
permit for such work, provided no changes have been made, or will
be made in the original plans and specifications for such work;
and provided, further, that such suspension or abandonment has not
exceeded one year.
SECTION 6: That section 8-308 of the Santa Ana Municipal Code
is hereby amended to read as follows:
Sec. 8-308. Permit required.
(a) It shall be unlawful for any person to install,
remove, alter, repair or replace or cause to be installed,
removed, altered, repaired or replaced any plumbing, gas or
drainage piping work or any fixture or water heating or
treating equipment in a building or premises without first
obtaining a permit to do such work from the administrative
authority.
(b) A separate permit shall be obtained for each
building, structure, each dwelling unit, each condominium
unit, each office suite, and each unit in a commercial or
industrial building.
(c) No person shall allow any other person to do or
cause to be done any work under a permit secured by a
permittee except persons in his employ.
SECTION 7: That the Santa Ana Municipal Code is hereby amended
by adding a section, to be numbered Section 8-313, which said
section shall read as follows:
Sec. 8-313. Expiration of plan review.
Applications for which no permit is issued within 180
days following the date of application shall expire by limitation,
and plans and other data submitted for review may thereafter be
returned to the applicant or destroyed by the building official.
In order to renew action on an application after expiration, the
applicant shall resubmit plans and pay a new plan review fee.

SECTION 8: That section 8-403 of the Santa Ana Municipal Code
is hereby amended by adding a section, to be designated numbered
section 8-403, which said section reads as follows:
Sec. 8-403. Materials (§401(a))
Section 401(a) of the Plumbing Code is hereby amended to
read as follows:
(a) Drainage pipe shall be cast iron, galvanized steel,
galvanized wrought iron, lead, copper, brass, ABS, PVC or
other approved materials having a smooth and uniform bore,
except that: (1) No galvanized wrought iron or galvanized
steel pipe shall be used underground and shall be kept at
least six (6) inches (152.4mm) above ground. (2) ABS or PVO
installations shall be limited to residential construction,
not more than two (2) stories in height. (3) No vitrified
clay pipe or fittings shall be used above ground and shall be
kept at least twelve (12) inches (.3m) below ground.
SECTION 9: That section 8-404 of the Santa Ana Municipal Code
is hereby amended by adding a section, to be numbered section
8-404, which said section reads as follows:
Sec. 8-404. Materials. (§ 503(a)).
Section 503(a) of the Plumbing Code is amended to read
as follows:
(a) Vent pipe shall be cast iron, galvanized steel,
galvanized wrought iron, lead, copper, brass, ABS, PVC or
other approved materials except that:
(1) No galvanized wrought iron or galvanized steel
pipe shall be used underground and shall be kept at
least six (6) inches above ground.
(2) ABS or PVC installations shall be

SECTION 10: That the Santa Ana Municipal Code is hereby amended
by adding a section, to be numbered 8-405, which said section

reads as follows:
Sec. 8-405. Materials. (~ 1004(a)).
Section 1004(a) of the Plumbing Code is hereby amended
to read as follows:
(a) Water pipe and fittings shall be of brass, copper,
cast iron, galvanized malleable iron, galvanized wrought
iron, galvanized steel, lead or other approved
materials. Asbestos-cement, PE, or PVC water pipe
manufactured to recognized standards may be used for
cold water distribution systems outside a building. All
materials used in the water supply system, except valves
and similar devices shall be of a like material, except
where otherwise approved by the Administrative
Authority.
SECTION 11: If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held to be
invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this ordinance. The City
Council of the City of Santa Ana hereby declares that it would
have adopted this ordinance and each section, subsection,
sentence, clause, phrase or portion thereof irrespective of the
fact that any one or more sections, subsections, sentence,
clauses, phrases, or portions be declared invalid or
unconstitutional.
SECTION 12: Neither the adoption of this ordinance nor the
repeal hereby of any ordinance shall in any manner affect the
prosecution for violation of ordinances, which violations were
committed prior to the effective date hereof, nor be construed as
affecting any of the provisions of such ordinance relating to the
collection of any such license or penalty or the penal provision
applicable to any violation thereof, nor to affect the validity of
any bond or cash deposit in lieu thereof, required to be posted,
filed or deposited pursuant to any ordinance and all rights and
