NS- 1828 AN oRDINANCE OF THE CITY OF SANTA ANA AMENDING SECTION 34-57 OF THE SANTA ANA MUNICIPAL CODE TO EXCEPT PROPERTY IN THE SD (SPECIFIC DEVELOPMENT) DISTRICT FROM THE MINIMUM LOT SIZE RESTRICTION IN THE SUBDIVISION REGULATIONS THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Section 34-57 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 34-57. Districting for minimum lot sizes. The city is divided into minimum lot area districts: Class I, Class II and Class III as shown on a map entitled "Dis- tricting Map for Minimum Lot Area Requirements," such districts having the following regulations: (1) The minimum area of a residential lot in minimum lot area district Class I as shown on said map shall be not less than six thousand (6,000) square feet and the minimum width of such lot at the official set-back line shall be not less than fifty (50'). Waiver of the provisions of this subsection may be granted as provided for in section 41-591(o) PRD or in a Specific Development Plan approved for property in an SD (Specific Development) District. (2) The minimum area of a residential lot in minimum lot area district Class II as shown on said map shall be not less than seventy-two hundred (7200) square feet, and a minimum width of such lot at the official set-back line shall be not less than sixty feet (60); (3) The minimum area of a residential lot in minimum lot area district Class III as shown on said map shall be not less than nine thousand (9,000) square feet, and the minimum width of such lot at the official set-back line shall be not less than seventy- five feet (75'). NS- 1828 PAGE TWO If the proposed subdivision lies within minimum lot area district Class III and fifty percent (50%) or more of the land within three hundred feet (300') of an exterior boundary of the proposed subdivision is subdivided into lots or parcels, the majority of which lots or parcels are smaller than the minimum area or frontage width requirements as set out herein for new subdivisions in these districts, then the lots in the proposed subdivision for a distance of three hundred feet (300') from the aforesaid boundary may be of such size in area and width as to conform to the requirements of a Class II minimum lot area district. SECTION 2: ~ If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court or competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or uncon- stitutional. SECTION 3: Neither the adoption of this Ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any cash deposit in lieu thereof, re- ORDINANCE NO. NS- 1828 PAGE THREE quired to be posted, filed or deposit pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
