NS-1834 REL:adg-24 1/6/86 AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING SECTIONS 41-472, 41-472.5, 41- 473 AND 41-88 OF THE SANTA ANA MUNICIPAL CODE AND ADDING SECTION 41-79, TO ALLOW COMMERCIAL USES AND IMPOUND YARDS IN THE M1 DISTRICT AND TO ELIMINATE THE RE- QUIREMENT FOR A CONDITIONAL USE PERMIT FOR A MINI-WAREHOUSE IN THE M1 DISTRICT THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Section 41-472 of the San~a Ana Municipal Code is amended to read as follows: Sec. 41-472. Uses permitted in the Mi district. The following uses are permitted in the Mi district: (a) The compounding, processing, packaging or treatment of such products as candy, cosmetics, drugs, perfumes, pharmaceuticals, toiletries, and food products, except the rendering and refining of fats and oils. (b) The manufacture, compounding, assembly of articles of merchandise from the following pre- viously prepared materials: Aluminum, bone, brass, cellophane, camel-back, canvass, cloth, cork, copper, feathers, felt, fibre, fur, glass, hair, horn, latex, lead, leather, paint, paper, plastics, precious or semi-precious metals or stone, shell, rubber, tin, iron, steel, tobacco, wood and yarns. (c) The manufacture of pottery, figurines or similar ceramic products using only previously pulverized clay and kilns fired only by electricity or gas. (d) Foundry casting lightweight, nonferrous metal. (e) Petroleum and gas storage. (f) Planing mill. (g) Machine shop or other metal working shops. ORDINANCE NO. (i) Mini-warehouses (j) Impound yards SECTION 2: That Section 41-472.5 of the Santa Ana Municipal Code is amended to read as follows: Sec. 41-472.5. Uses subject to a conditional use permit in the Mi district. The following uses may be permitted in the Mi district subject to the issuance of a conditional use permit: (a) Any use which may be permitted in the C2 district subject to the issuance of a conditional use permit pursuant to Section 41-377.5. (b) Storage or temporary location of new or used buildings or houses. SECTION 3: That Section 41-473 of the Santa Ana Municipal Code is amended to read as follows: Sec. 41-473. Operational standards in the Mi District. (a) Any activity permitted in this district shall be conducted in such a manner as not to have a deterimental effect on permissible adjacent uses by reason of refuse matter, noise, light, vibration, or maintenance of grounds or buildings. (b) Outdoor storage of materials, products or equipment uses, produced or manufactured by a permitted use shall be located adjacent to the rear or side of the main buildings, and said storage area shall be screened by a solid fence or wall not less than six (6) feet in height. (c) When front and side yards are required as set forth in section 41-475 and section 41-476, said front and side yards shall be landscaped. (d) Any permitted uses to be established on a lot in the Mi district, the rear or side lot line of which abuts property situated in any R district, shall be required to erect and maintain a solid wall or fence not less than six (6) feet in height along such rear or side lot line. ORDINANCE NO. NS-1834 PAGE THREE (e) Public utility electric distribution and transmission substations shall be enclosed within a solid wall or chain link fence not less than six (6) feet in height. (f) Any person building, erecting, altering or replacing any article, machine, equipment or other contrivance, the use of which may cause the issuance of air contaminants, shall prior to the issuance of building permit, present the planning department with a written statement from the office of the air pollution control officer of the air pollution control district of Orange County stating that said use shall meet with the regulations of said air pollution- control district. (g) Ail major compounding, processing, packag- ing or assembly of articles of merchandise, and treatment of products, shall be conducted within a completely enclosed building. (h) Any use which is permitted or conditionally permitted in the M1 district because it is per- mitted or conditionally permitted in the C2 district shall be conducted in accordance with the operational standards applicable to the C2 district pursuant to Section 41-378. SECTION 4: That Section 41-88 of the Santa Ana Municipal Code is hereby amended to read as follows~ Sec. 41-88. Junk yards, automobile wrecking yards, and salvage yards. A junk yard, automobile wrecking yard, or salvage yard is any space of two hundred (200) square feet or more of area of any lot used for the storage, sale, keeping or abandonment of inoperable vehicles, junk or waste material, including scrap metal or other scrap materials, or for the dismantling, demoli- tion or abandonment of automobiles, other vehicles, machinery or parts thereof, other than an impound yard. SECTION 5: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 41-79, which said section reads as follows: ~RDINANCE NO. NS-1834 PAGE FOUR Sec. 41-79. Impound yard. An impound yard is an area used for the temporary storage of vehicles which have been towed to such area due to having been abandoned or illegally parked or for a similar reason, and where there is no dismantlement of such vehicles nor any sale of the parts thereof. SECTION 6: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court or competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irresDective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or uncon- stitutional. SECTION 7: Neither the adoption of this Ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as. affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any cash deposit in lieu thereof, re- quired to be posted, filed or deposit pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
