REZONING CERTAIN PROPERTY LOCATED

TO THE SD (SPECIFIC DEVELOPMENT
AND ADOPTING SPECIFIC PLAN
NO. 44
WHEREAS, Amendment.Application N, 976 has been filed to
make a certain change ~ ~h~ zoning ~ ric designation of
certain real property, ~sJhereinaft. r set forth; and

WHEREAS, the ~iing Commi s/_~ n after duly noticed
public hearing, has recommended )proval of the change in use
district designati~ as prop in said Amendment Application;
and the approval o~Specific ~ment Plan No. 44 for said

SPECIFIC DEVELOPMENT PLAN NO 44
Section 1. APPLICABILITY OF ORDINANCE
The speci£ic development zoning district £or the subject
property, as authorized by Chapter Il, Division 26, Sect:
al-595 and sequence of the Santa Aha Municipal Code, is
specifically subject to the standards and regulations
contained in this plan and for the express purpose ot
establishing land use regulations and standards.
Section 2. pURPOSE
The Specific Development Plan, consisting ,ndards and
regulations, is hereby established for the ~ress purpose
o£ protecting the health, saEety, and welfare for
the people o£ the City by promoting nhancing the value
o£ the properties and encouraging ord~ ly development.
Section $. USES PERMITTED
-- The uses permitted in this Specit Development zone shall
be ancillary uses to the commer( properties fronting on
17th street. Such uses shall ~clude those uses as
permitted in the C1 commercia districts.
Section 4. SET BACK REI IREMENTI
-- Along the northernmost y of the Specific Development
there shall be a 45 ft ~uilding setback. No building or
portion o£ that build g may be constructed in this &5 ft.

by the other agencies for appropriate ~onditions
prior to bmission to the Planning Commission for
