ORDINANCE NO. NS- 1926
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA ADDING SECTIONS 21-111
AND 21-120o TO THE SANTA ANA MUNICIPAL CODE,
RELATING TO THE BUSINESS LICENSE TAX ON THE
BUSINESS OF OFF-PREMISE COMMERCIAL ADVERTISING
SIGNS.
'i/4E CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS
FOLLOWS:
SECTION 1: That the Santa Aha Municipal Code, is hereby
amended by adding a section, to be numbered 21-111, which said
section reads as follows:
Sec. 21-111.
Off-premise commercial advertising signs; erecting
of, maintaining of, selling of advertising space
there for.
Any person engaged in transacting and carrying on the business
of erecting, maintaining and selling of advertising space on off-
premise commercial advertising signs shall pay a license tax
therefo~ per.sign face located in the city. For sign faces with
gross d zmenslons equal to or less than three hundred (300) square
feet said tax shall be at the rate of seventy-five dollars
($75.00) per sign face. For sign faces with gross dimensions in
excess of three hundred (300) square feet said tax shall be at
the rate of one hundred dollars ($100.00) per sign face.
SECTION 2: That the Santa Aha Municipal Code, is hereby amended
by adding a section, to be numbered 21-120o, which said section
reads as follows:
Sec. 21-120o. Off-premise commercial advertising signs.
OFF-PREMISE COMMERCIAL ADVERTISING SIGNS:
(1) Sign faces with gross dimensions equal to or less than
three hundred (300) square feet, per sign face $75.00 A
(2) Sign faces with gross dimensions in excess of three hundred
(300) square feet, per sign face $100.00 A

SECTION 3: If any section, subsection, sentence, clause, phrase
or portion of this ordinance is for any reason held to be invalid
or unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of this ordinance. The City Council of the
City of Santa Ana hereby declares that it would have adopted this
ordinance and each section, subsection, sentence, clause, phrase
or portion thereof irrespective of the fact that any one or more
sections, subsections, sentences, clauses, phrases, or portions
be declared invalid or unconstitutional.
SECTION 4: Neither the adoption of this Ordinance nor the repeal
hereby of any ordinance shall in any manner affect the
prosecution for violation of ordinances, which violations were
committed prior to the effective date hereof, nor be construed as
affecting any of the provisions of such ordinance relating to the
collection of any such license or penalty or the penal provision
applicable to any cash deposit in lieu thereof, required to be
posted, filed or deposited pursuant to any ordinance and all
rights and obligations thereunder appertaining shall continue in
full force and effect.
