NS- 1966 AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING SECTION 29-1 OF THE SANTA ANA MUNICIPAL CODE AND ADDING SECTIONS 29-1.1 AND 29-1.2 THERETO TO PROVIDE FOR ANNUAL PERMITS FOR POOL AND BILLIARDS ESTABLISH- MENTS AND TO PROVIDE FOR A FEE FOR SUCH PERMIT APPLICATIONS THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That section 29-1 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 29-1. Permit - Required; application; granting or denying. No person shall engage in any business where games of billiards or pool are conducted unless a permit for such business has been issued by the chief of police and such permit has not expired or been revoked. Any person desiring to engage in any such business shall first make application in writing for such permit to the chief of police. The chief of police shall have full power to grant or deny said permit and, after investigation, if it shall appear to the chief of police that said person is a proper and suitable person and the location and arrangement of the proposed place where said business is to be conducted is satisfactory, the chief of police shall grant said permit, subject to all applicable pro- visions of this Code; otherwise, he shall deny the same. Any person aggrieved by the refusal of the chief of police to grant a permit may appeal the decision to the city council as provided in Chapter 3 of the City Code. SECTION 2: That the Santa Ana Municipal by adding a section, to be numbered 29-1.1, reads as follows: Code is hereby amended which said section Sec. 29-1.1. Permit term. No permit required by section 29-1 shall be issued by the chief of police for a period in excess of twelve (12) months. 430 ORDINANCE NO. NS-1966 PAGE TWO The expiration date of said permit shall be December 31 of each calendar year. SECTION 3: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 29-1.2, which said section reads as follows: Sec. 29-1.2. Permit fee. Every application for a permit required by section 29-1 shall be accompanied by an application fee in such amount as shall be established by resolution of the city council. Any person applying for a permit of less than twelve (12) months shall pay a prorated fee. SECTION 4: Permits granted pursuant to Chapter 29 of the Santa Ana Municipal Code in effect on the effective date of this ordinance shall expire on December 31, 1988, if not sooner revoked. SECTION 5: Until such time as a different fee may be set by resolution of the City Council, the fee required by section 29-1.2 as added to the Santa Ana Municipal Code by this ordinance, shall be $150.00 per year. SECTION 6: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases,. or portions be declared invalid or unconstitutional. SECTION 7: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any 431 ~JDINANCE NO.
