AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA AMENDING SECTIONS 2-600,
2-603, 2-604, AND 2-607; REPEALING SECTIONS
2-602, 2-605, 2-606, 2-608 AND 2-609; AND
ADDING ARTICLE XV TO CHAPTER 13 OF THE SANTA
ANA MUNICIPAL CODE RELATING TO THE SANTA
ANA PUBLIC LIBRARY.
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN
AS FOLLOWS:
SECTION 1: That section 2-600 of the Santa Ana Municipal
Code is hereby amended to read as follows:
Sec. 2-600. Establishment.
A public library is established in the City for its
inhabitants and nonresident taxpayers. The public library
shall provide free basic library services, subject always
to such ordinances and resolutions as may be made bY the
city council. Any person who violates any such ordinance
or regulation may, in addition to any other penalty, be
excluded from the privileges of the library.
SECTION 2: That section 2-602 of the Santa Ana Municipal
Code is hereby repealed.
SECTION 3: That section 2-603 of the Santa Ana Municipal
Code is hereby amended to read as follows:
Sec. 2-603. Library board.
There is hereby established the library board of the
City of Santa Ana, having such powers as set forth in this
division. The library board shall consist of seven (7)
members who shall be subject to appointment and removal and
shall serve terms in accordance with section 901 of the
Charter of the City of Santa Ana.
SECTION 4: That section 2-604 of the Santa Ana Municipal
Code is hereby amended to read as follows:
Sec. 2-604. Scope of authority.
The library board shall have the following powers
and duties:

SECTION 5: That section 2-605 of the Sa~
Code is hereby repealed.

Code is hereby repealed.
SECTION 7: That section 2-607 of the Sa]
Code is hereby amended to read as follows:

ARTICLE XV. LIBRARY FUND
Sec. 13-140. Creation of library fund.
There is hereby created and established the
"Library Fund."
Sec. 13-141. Deposit of moneys.
Amounts received from library fund raising activities,
donations, and amounts derived from gifts, bequests and
devises to the library shall be deposited in the library
fund.
Sec. 13-142. Expenditure of funds.
Money in the library fund shall only be expended for
library purposes.
SECTION 11: That membership and terms of office of the library
board as it exists on the date of adoption of this ordinance
shall continue without interruption under this ordinance.
SECTION 12: If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held to
be invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this ordinance. The City
Council of the City of Santa Ana hereby declares that it would
have adopted this ordinance and each section, subsection, sent-
ence, clause, phrase or portion thereof irrespective of the
fact that any one or more sections, subsections, sentences,
clauses, phrases, or portions be declared invalid or unconsti-
tutional.
SECTION 13: Neither the adoption of this ordinance nor the
repeal hereby of any ordinance shall in any manner affect the
prosecution for violation of ordinances, which violations were
committed prior to the effective date hereof, nor be construed
as affecting any of the provisions of such ordinance relating
to the collection of any such license or penalty or the penal
provision applicable to any violation thereof, nor to affect
the validity of any bond or cash deposit in lieu thereof,
required to be posted, filed or deposited pursuant to any
