NS-2D09 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING DIVISION ELEVEN SECTIONS 2-660 AND 2-661 OF THE SANTA ANA MUNI- CIPAL CODE RELATING TO THE COMMUN- ITY CABLE CITIZENS BOARD. DMF:mb(36 ) 4/6/89 THE CITY COUNCIL OF THE CITY OF SANTA AS FOLLOWS: DOES ORDAIN SECTION 1: That Division 11 of Article the Santa Ana Municipal Code is hereby ame of Chapter 2 of to read as follows: DIVISION 11. CABLE TELEVISION BOARD Sec. 2-660. Establishment of c~ television advisory board. There is hereby establis the cable television advisory board of the City of having such powers as set forth in this cable television advisory board shall consist of se who shall be subject to appointment and ~d shall serve terms in accordance with section 901 Charter of the City of Santa Ana. Sec. 2-661. (2 It shall conduct state of the art reviews as re- quired by any cable television franchise agreement and report its findings to the city council and city manager. (3) It shall conduct an annual review of the quality of service provided by any cable television fran- chisee and report its findings to the city council and city manager. (4) It shall hear and resolve controversies between complaining persons and any cable television fran- chisees which cannot be resolved between the com- plaining person and the franchisee. ORDINANCE PART TWO NO. NS- 3309 SECTION 4: If any section, subsection, sentence, phrase or portion of this ordinance is for any reason hel~ be invalid or unconstitutional by the decision of any cc of competent jurisdiction, such decision shall not affect validity of the remaining portions of this ordinance City Council of the City of Santa Ana hereby declares tha it would have adopted this ordinance and each section, subs sent- ence, clause, phrase or portion thereof irres of the fact that any one or more sections, subsections ;entences, clauses, phrases, or portions be declared inva or unconsti- tutional. SECTION 5: Neither the adoption of thi nor the repeal hereby of any ordinance shall in manner affect the prosecution for violation of ordinances violations were committed prior to the effective date , nor be construed as affecting any of the provisions oJ ordinance relating to the collection of any such licens or penalty or the penal provision applicable to any violat~ thereof, nor to affect the validity of any bond or cash )osit in lieu thereof, required to be posted, filed or ~osited pursuant to any ordinance and all rights and ~ions thereunder appertain- ing shall continue in full fo~ and effect.
