NS- 2035 REL:mb(24a) 9/25/89 AN ORDINANCE OF THE CITY OF SANTA ANA AMEND- ING SECTIONS 41-313, 41-313.5, 41-314, &!.-315, 41-316 AND 41-317 OF THE SANTA ANA MUNICIPAL CODE, ADDING SECTIONS 41-319, 41-320, 41-321 AND 41-322, AND REPEALING SECTIONS 41-326 THROUGH 41-332, TO REVISE THE ZONING REGULATIONS APPLICABLE TO THE P (PROFESSIONAL) DISTRICT AND DELETE THE ZONING REGULATIONS APPLICABLE TO THE LP (LIMITED PROFESSIONAL) DISTRICT. THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That section 41-313 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-313. Uses permitted in P district. The following uses are permitted in the P district: (a) Professional, business and administrative offices where no merchandise is sold. b) Banks, savings and loan offices, credit unions, mortgage and finance companies, securities and commodities, bail bonds services, and other financial services. (c) Real estate, insurance and other business ser- vices, including advertising; public relations; limited print and copy services; and secretarial, stenographic and telephone answering services. (d) Public and quasi-public non-commercial uses of an administrative, educational, religious, cultural, communications or public service nature. (e) Travel agencies. (f) Medical and dental offices. (g) Pharmacies, limited to the dispensing of goods and merchandise related to health care only. (h) Professional offices for marriage and family counselors, psychologists, psychiatrists and social workers. (i) Ambulance and emergency medical response services. 304 ORDINANCE NO. NS- 2035 PAGE TWO j) SECTION 2: Code k) Parking lots and structures in conjunction with a permitted use, except that no cars either new or used shall be stored for sale or offered for sale or parked when such car bears signs, words, or figures indicating that the same may be for sale, and no hydrocarbon substance or other prop- erty of any kind may be sold and no automobile serviced or repaired. 1) Commercial uses which do not exceed ten (10) per- cent of the building area of all the buildings on the parcel on which they are located and which are supportive of, compatible with, and integrated into the professional and business uses on such parcel, excluding retail centers and drive-thru facilities. Exhibit, gallery or display space not to exceed 10 percent of the building area of all the build- ings on the parcel on which they are located and which are supportive of, compatible with, and integrated into the professional and business uses on such parcel, excluding retail centers and drive-thru facilities. That section 41-313.5 of the Santa Ana Municipal is hereby amended to read as follows: Sec. 41-313.5. Uses subject to a conditional use permit in the P district. The following may be permitted in the P district sub- ject to the issuance of a conditional use permit: a) Convalescent hospitals, nursing homes, rest homes, and extended care facilities. b) Hospitals, but excluding mental hospitals. c) Churches and accessory church buildings. d) Public buildings and public utility buildings and structures including electric distribution and transmission substations. e) Nursery schools. 305 ORDINANCE NO. NS- 2035 PAGE THREE SECTION 3: That section 41-314 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-314. Building height. (a No structure shall exceed 35 feet in height ex- cept as provided by Section 41-602 for Height District II. (b Notwithstanding the provisions of Section 41- 602(d), all structures shall not exceed three stories or 35 feet within 140 feet of property used or zoned for residential purposes. (c Notwithstanding any other height provision of this chapter, all structures shall not exceed two stories or 25 feet in height within the rear 50 percent of a lot abutting on the rear property line of property zoned or used for residential purposes. SECTION 4: That section 41-315 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-315. Building setbacks. (a Front - Ail structures shall maintain a 15 foot setback from the front property line. (b Side - (1) Ail structures shall maintain a 15 foot setback from side property lines abutting a street. (2) All structures shall also main- tain a five foot setback from interior side prop- erty lines. (3) All stories above and exclusive of the second story or 25 feet in height, shall maintain an additional setback of not less than two feet for each foot above the second story if the lot is abutting property used or zoned for residential purposes. (c) Rear - Ail structures shall maintain a 50 foot rear setback if the lot abutting on the rear property line is a parcel used or zoned for residential purposes. In all other cases, all structures shall maintain a 10 foot rear setback. 306 ORDINANCE NO. NS-2035 PAGE FOUR SECTION 5: That section 41-316 of the Santa Ana Municipal Code is hereby amended to read as follows: Sec. 41-316. Landscaped area. (a) Front - There shall be a landscaped front yard area of not less than 15 feet. (b) Side - There shall be a landscaped side yard area of not less than five feet. On corner lots, the landscaped side yard shall not be less than 15 feet. (c) Rear - There shall be a landscaped rear yard area of not less than 10 feet if the lot abutting on the rear property line is a parcel used or zoned for residential purposes. There shall be a land- scaped rear yard of not less than five feet in all other cases. (d) Ail required yards shall be landscaped and main- tained at all times. Plant material shall be pro- vided per the Commercial Landscape Standards. SECTION 6: That section 41-317 of the Santa Ana Municipal Code is amended to read as follows: Sec. 41-317. Landscaping, building perimeter. A landscape area shall be provided around and abutt- ing each building. The area of landscaping shall be equal to or greater than three times (3x) the perimeter dimen- sions of the building, but in no case shall be less than five feet in width. The side yard landscaping abutting the building may be considered as part of this landscape requirement. SECTION 7: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 41-319, which said section reads as follows: Sec. 41-319. Parking lot landscaping. Interior parking lot landscaping shall be provided at a rate of one planter for each 10 parking spaces. Land- scape planter areas shall be provided with plant material 307, ORDINANCE NO. NS- 2035 PAGE FIVE per the commercial area landscape standards. The minimum dimension of each landscape planter shall be 8.5 feet in width by 18 feet in length. SECTION 8: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 41-320, which said section reads as follows: Sec. 41-320. Parking structure landscaping. One (1) square foot of landscaping and decorative pedestrian hardscape in a plaza or around the perimeter of the parking structure shall be provided for every 50 square feet of parking structure footprint area. SECTION 9: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 41-321, which said section reads as follows: Sec. 41-321. Residential conversions. Required setbacks and yards shall be reduced as necessary to allow existing one and two-story residential buildings to be converted to a use permitted by this division. All other provisions of this division must be met by such conversions. SECTION 10: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 41-322, which said section reads as follows: Sec. 41-322. Wall requirements. A six (6) foot high minimum solid decorative masonry wall designed in the same manner as the proposed building shall be provided along the side and rear property lines. Notwithstanding, said wall shall not exceed 42 inches in height within 20 feet of the property line abutting a street. If the site is abutting a non-residential use, the wall height requirement may be reduced by the Planning Director. SECTION 11: That "Division 9. LP (Limited Professional)" of Article III of Chapter 41 of the Santa Ana Municipal Code, con- sisting of sections 41-326 through 42-332, inclusive, is hereby repealed in its entirety. 308 ORDINANCE NO. NS- 2035 PAGE S IX SECTION 12: Any property located in the LP (Limited Pro- fessional) District shall be subject to the regulations of the P (Professional) District, as amended by this ordinance, and as they may from time to time hereafter be amended, until the dis- trict designation of such property is changed. SECTION 13: Any residential development project in the P (Professional) zone as to which a conditional use permit appli- cation was filed prior to September 11, 1989 shall be subject to the zoning regulations applicable to such project as they existed immediately prior to the adoption of this ordinance. Any development project as to which a building permit application has been filed prior to the adoption of this ordinance shall be subject to the zoning regulations applicable to such project as they existed immediately prior to the adoption of this ordinance, provided such application does not expire without issuance of the building permit, and provided the building permit, if issued, does not expire without commencement of construction. SECTION 14: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sent- ence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconsti- tutional. SECTION 15: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any 309 ORDINANCE NO.
