NS- 2052 AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING SECTION 16-29.5 OF THE SANTA ANA MUNICIPAL CODE CLARIFYING THE MEANING OF THE INDUSTRIAL WASTE EXCLUSION IN THE CITY'S REFUSE COLLECTION REGULATIONS THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN FOLLOWS: That section 16-29.5 of the Santa Ana Municipal amended to read as follows: Sec. 16.29.5. Exclusions from "refuse." The following items are not "refuse" for purposes of this article: 1) A flammable waste. 2) A containerized waste (e.g., a drum, barrel, portable tank, box, pail, etc.). 3) A waste transported in a bulk tanker. 4) A liquid waste. 5) A sludge waste. 6) A waste from an industrial process, which waste is not eligible for disposition in a class III landfill under applicable laws and regulations of the State of California. 7) A waste from a pollution control process. 8) Residue and debris from the cleanup of a spill or release of chemical substances, commercial products or any other special wastes. 442 ORDINANCE NO. NS- 2052 PAGE TWO (9) Contaminated soil, waste, residue, debris and articles from the cleanup of a site or facility formerly used for the generation, storage, treatment, recycling, reclamation or disposal of any other special wastes. (10) Dead animals. (11) Manure. (12) Sewage waste. (13) Waste water. (14) Explosive substance. (15) Radioactive materials. (16) Materials which have been exposed to highly infectious or contagious diseases. (17) Hazardous materials. SECTION 2: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sent- ence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconsti- tutional. SECTION 3: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were cc~amitted prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, 44[3 ORDINANCE NO. NS-2052 PAGE THREE required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertain- ing shall continue in full force and effect.
