NS-2067 AN ORDINANCE OF THE CITY OF SANTA ANA ADDING SECTION 2-108 TO THE SANTA ANA MUNICIPAL CODE PROHIBITING DISCLOSURE OF CLOSED SESSION DISCUSSIONS WITHOUT AUTHORITY OF THE CITY COUNCIL EJC:ar/mb(7) 06/05/90 THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOW'S: SECTION 1: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 2-108, which said section reads as follows: Sec. 2-108. Disclosures from closed session. It shall be unlawful for any member of the city council, or any officer or employee of the city or any other person present during a closed session of the city council to disclose to any person the content or sub- stance of any discussion which took place during such closed session on any matter legally authorized to be heard in closed session, unless the city council has authorized the disclosure of such information by majority vote. SECTION 2: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sen- tence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconsti- tutional. 600 ORDINANCE NO. NS- 2~67 PAGE TWO SECTION 3: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were c~mmitted prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertain- ing shall continue in full force and effect.
