NS- 2087 AN ORDINANCE OF THE CITY OF SANTA ANA REVISING THE OFF STREET RESI- DENTIAL PARKING REGULATIONS IN THE ZONING CHAPTER OF THE MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Article XV is hereby added to Chapter 41 of the Santa Ana Municipal Code, which said article reads as follows: ARTICLE XV. OFF-STREET PARKING DIVISION 1. GENERAL REQUIREMENTS Secs. 41-1300--41-1319. Reserved. DIVISION 2. RESIDENTIAL STANDARDS Sec. 41-1320. Single-family dwellings. (a) The minimum off-street parking requirements for single-family dwellings are as follows: Four spaces. (b) Of the spaces required by subsection (a), two spaces shall be in an enclosed garage. The remaining spaces may be tandem spaces in a driveway. Sec. 41-1321. Two-family and three-family dwellings. (a) The minimum off-street parking requirements for each dwelling unit in a two-family or three-family dwelling are as follows: Three spaces plus one additional space for each bedroom in excess of two bedrooms. (b) Of the spaces required by subsection (a), two spaces shall be in an enclosed garage. The remaining spaces may be tandem spaces in a driveway, provided such driveway spaces may not obstruct access to parking spaces serving any other unit. Sec. 41-1322. Multiple family dwellings. (a) The minimum off-street parking requirements for each ORD .^r CE ,0. NS-2087 ?22 PAGE TWO dwelling unit in multiple-family dwellings are as follows: One space in a garage or carport. (b) Each multiple-family dwelling site shall provide off- street parking spaces in addition to the minimum requirements of subsection (a) of this section, in an amount not less than the number of bedrooms on the site. Such spaces may be open or covered and may be assigned to particular units or not so assigned. Bachelor units shall be considered as one-bedroom units. (c) In addition to the minimum requirements of subsections (a) and (b) of this section, each multiple family dwelling site shall provide guest parking, identified as such, in an amount of spaces not less than 25 per cent of the minimum required spaces under subsections (a) and (b) of this section, but in no case less than three spaces. Such guest parking shall be open and outside any secured area. SECTION 2: That sections 41-617(a) and 41-617(b) of the Santa Ana Municipal Code are hereby repealed. SECTION 3: If application for a building permit for development of any particular property has been filed pursuant to Chapter 3 of the Building Code prior to the effective date of this ordinance, such property may be developed in accordance with the off-street parking requirements set forth in Chapter 41 of the Santa Ana Municipal Code as they existed immediately prior to their amendment by this ordinance; provided, however, that in the event that such building permit application expires without issuance of a building permit, or, if a building permit is issued, if such building permit expires without the commencement of construction pursuant thereto, then any subsequent development of such property must comply with the off- street parking requirements set forth in this ordinance. SECTION 9: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional. SECTION 5: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of 2 OR mA,C 725 PAGE THREE ,'~ the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
