ORDINANCE NO. NS-2096
AN ORDINANCE OF THE CITY OF SANTA ANA ADDING
SECTIONS 41-65.5 and 41-193 TO THE SANTA ANA
MUNICIPAL CODE TO REGULATE GARAGE SALES
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS
FOLLOWS:
SECTION 1: That the Santa Ana Municipal Code
amended by adding a section, to be numbered 41-65.5,
section reads as follows:

Sec. 41-65.5. Garage sale.
A garage sale is a sale of goods, wares or merchan-
dise from residential property where the public is invi-
ted on to such property to purchase such items.
SECTION 2: That the Santa Ana Municipal Code is hereby
amended by adding a section, to be numbered 41-193, which said
section reads as follows:
Sec. 41-193. Garage sale regulations.
No person shall conduct a garage sale in violation
of the following regulations:
(a)
A garage sale may not last longer than three
(3) consecutive days.
(b)
No more than two (2) garage sales may be con-
ducted at the same address in any one calendar
year.
(c) Garage sale activity shall be limited to the
hours of 8:00 a.m. to 8:00 p.m.
(d) Garage sale activity may not by conducted in
the public sidewalks, parkways, streets, or
alleys.
(e)
Ail items sold at a garage sale must be used
goods, wares or merchandise of a household
nature.
(f)
Garage sale advertising signs may not be
posted on telephone poles, streets lights,
traffic signs, or any other structure in the
public right-of-way. Such signs may not be

posted anywhere earlier than one week prior to
the first date of the garage sale nor more
than one day after the last date of the garage
sale.
SECTION 3: If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held to be
invalid or unconstitutional by the decision of any court of com-
petent jurisdiction, such decision shall not affect the validity of
the remaining portions of this ordinance. The City Council of the
city of Santa Ana hereby declares that it would have adopted this
ordinance and each section, subsection, sentence, clause, phrase or
portion thereof irrespective of the fact that any one or more sec-
tions, subsections, sentences, clauses, phrases, or portions be de-
clared invalid or unconstitutional.
SECTION 4: Neither the adoption of this ordinance nor the re-
peal hereby of any ordinance shall in any manner affect the prose-
cution for violation of ordinances, which violations were committed
prior to the effective date hereof, nor be construed as affecting
any of the provisions of such ordinance relating to the collection
of any such license or penalty or the penal provision applicable to
any violation thereof, nor to affect the validity of any bond or
cash deposit in lieu thereof, required to be posted, filed or depo-
sited pursuant to any ordinance and all rights and obligations
thereunder appertaining shall continue in full force and effect.
