NS-2140 AN ORDINANCE OF THE CITY OF SANTA ANA REZONING VARIOUS PROPERTIES IN THE CITY TO ACHIEVE CONSISTENCY WITH THE GENERAL PLAN AND WITH CURRENT OR PROPOSED USES OF SUCH PROPERTIES (AA 1052, AS IT PERTAINS TO THE AREA NORTH OF FIRST STREET BETWEEN SPURGEON AND LACY STREETS) 1 I 025 I I I REL: 7/5/91 I i I I I WHEREAS, Amendment Application No. 1052 has been filed to make certain changes in the zoning district designations of various properties located in the City as hereinafter set forth; and WHEREAS, this Council prior to adopting this ordinance, has reviewed the initial environmental study prepared for this project, and has approved the Negative Declaration for this project based thereon; and WHEREAS, this council, after duly noticed public hearing has determined the changes in use district designation proposed in the abovesaid Amendment Application are justified by the public necessity, convenience and general welfare; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: 1. That exhibit numbered 4, attached hereto, is hereby incorporated herein by reference. 2. The following area delineated in Exhibit 4 is hereby reclassified from its current use district to the use district specified for it hereinbelow: Exhibit Area Use District 4 C R2 (Two-family residence) 3. An amended Sectional District Map number 7-5-9 showing the above described change in use district designation is hereby approved. 4. Any real property which on or before the date of adoption of this Ordinance meets either or both of the following conditions shall, at the option of the owner of the property, be subject to 1 ORDINANCE NS-2140 PAGE TVJO . . 027 the use district regulations which applied to such property immediately prior to this Ordinance. ~, (a) Development was approved for the property through the approval of a conditional use permit or a tentative subdivision map. (b) Application for a permit for such development has been filed pursuant to Chapter 3 of the Building Code; provided, however, this section shall cease to apply to any development for which a conditional use permit or tentative map was approved if the conditional use permit or tentative map expires or is revoked for good cause, or to any development for which a building permit application expires without issuance of the building permit, or to any development for which a building permit is issued but expires without the commencement of construction.
