NS- 2151 r AN ORDINANCE OF THE CITY OF SANTA ANA ADDING ARTICLE XVI TO CHAPTER 41 OF THE SANTA ANA MUNICIPAL CODE, TO REGULATE JUNK YARDS, SALVAGE YARDS, AUTOMOBILE WRECKING YARDS, IMPOUND YARDS, AND VEHICLE STORAGE YARDS THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: al Code is hereby which said Sec. 41-45. Impoun An impound yard is a confined area and/or building which is used to hold in legal custody, for temporary periods of time, motor vehicles, motorized bicycles, boats on trailers, travel trailers, similar type vehicles, for the express purpose of restricting the registered owner's use of the vehicle until such time as a fee/bill is paid and where there is no dismantlement of such vehicles nor any sale of parts thereof. SECTION 3: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 41-166.5, which said section reads as follows: Sec. 41-166.5. Vehicle storaqe facility. ~ A vehicle storage facility is an area, a minimum of two hundred (200) square feet or more, on any lot, used for the purpose of arranged vehicle storage, with or without compensation by the owner. 1 ~_' r_ 123 SECTION 4: That section 41-472 of the Santa Ana Municipal Code is hereby amended to read as follows: r section 41-472. Uses permitted in the M-1 district. The following uses are permitted in the M-1 district: (a) The compounding, processing, packaging or trea ent of such products as candy, cosmetics, drugs, erfumes, pharmaceuticals; toiletries, and food produ s, except the rendering and refining of fats and oils (b) The manufacture, compounding, assembly articles of merchandise from the following prevo usly prepared materials: Aluminum, bone, brass, cellophane, c mel-back, canvass, cloth, cork, copper, feathers, fel , fibre, fur, glass, hair, horn, latex, lead, leather, 9 int, paper, plastics, precious or semi precious metals stone, shell, rubber, tin iron, steel, tobacco, wood nd yarns. (c) The manufacture of pottery, gurines or similar ceramic products using only previou y pulverized clay and kilns fired only by electricity r gas. (h) her metal working shops. ARTICLE T at the Santa Ana Municipal Code is hereby article to Chapter 41 thereof, which said sections 41-1601 through 41-1611 and reads as SECTION 10: amended by adding article consists 0 follows: STANDARDS FOR JUNK YARDS, SALVAGE YARDS, AUTOMOBILE WRECKING YARDS, IMPOUND YARDS, AND VEHICLE STORAGE FACILITIES Sec. 41- Applicability of standards. The standards and requirements set forth herein are for the express purpose of establishing regulations and standards for junk yards, salvage yards, automobile wrecking yards, impound yards, vehicle storage facilities, and commercial vehicle storage 4 r .129 facilities not operated within an enclosed building. ~ sec. 41-1602. purpose. The purpose of the standards detailed herein is to reduce the potential impacts caused by the inappropriate operation of junk yards, salvage yards, automobile wrecking yards, impound ards, vehicle storage facilities, and commercial vehicle storage facilities. These uses may be detrimental to surrounding and uses and values due to noise, fumes and aesthetic and en ronmental degradation. (a) Junk yards, salvage yards, automob' e wrecking yards, impound yards, vehicle storage facilities, a commercial vehicle storage facilities shall conform to the use strict limitations on location established by Article III of thi chapter, including any applicable requirement for a conditional se permit. Sec. 41-1603. Location. (b) In addition, no junk yard salvage yard, automobile wrecking yard, impound yard, veh'cle storage facility, or commercial vehicle storage facility all be established within 500 feet of property zoned or used for open space or residential land uses. Sec. 41-1604. Screening. (a) The operations of junk yard, salvage yard, automobile wrecking yard, impound rd, vehicle storage facility, or commercial vehicle storag facility shall be screened by a solid wall from adjacent prope ies and public streets. All screening walls shall be located ehind required setbacks and landscaped areas. Screening wal s, facing a public right of way, shall contain a landscape e clave, a minimum of five (5) feet wide and five (5) feet deep fo every thirty-five (35) feet of wall length. In no instance sh 1 the screening wall encroach within the required front yar setback. (b) The st rage of wrecked vehicles, auto parts, equipment and/or salvage aterials shall take place behind a walled yard. Salvage materi ls or wrecked vehicles shall not be piled higher than the wal within the front twenty-five (25) feet of the enclosed yar facing a public right of way. In no instance shall the stacks f materials be higher than twelve (12) feet on the site. (c) No salvage materials, wrecked automobiles, automobiles purchased for salvage, impounded vehicles or vehicles stored on site shall be permitted to remain outside the solid walls surrounding the site. 5 131 (d) screening walls shall be a minimum of eight (8) feet in height to a maximum of ten (10) feet high. No walls shall exceed four (4) feet in height were they extend into any required front yard or any required landscape area. ,r (e) All walls used to screen the storage or work area shall be constructed of solid, decorative masonry materials. Gates shall be constructed of decorative metal and shall fully s reen the facility. Wooden gates or chain link gates with wood, p astic, or metal slats are not permitted. Wrought iron may be p rmitted on top of the minimum eight foot high masonry wall to a m imum of ten (10) feet in height total for the fence. Barbed wir (straight or concertina) may be permitted below the solid masonr fence, out of view from the public right of way. Sec. 41-1605. Fuel and Fluid storage. Automotive and engine repair curring at any impound yard, vehicle storage facility or comm cial vehicle storage facility shall be restricted to within a enclosed building. The repair facilities shall comply with t automotive repair standards and the off-street parking requir ments for auto repair facilities. All business activities, exce t vehicle storage shall be conducted and located within an enclo d building. (a) Impound yard, vehicle storage facilities, and commercial vehicle storage faci ties shall have an on-site office building. Dispatching of vehi es is permitted. Sec. 41-1607. (b) The off' e building shall be constructed outside of the enclosed storag yard area. No temporary trailers shall be permitted on-si e to fulfill this requirement. (a) The yard area shall be paved with a minimum of a four (4) inch cover of concrete with six (6) inches of gravel underlain or 6 ~- :133 (~ four (4) inch cover of asphalt with ten (10) inches of gravel underlain. Gravel cover or any porus material is not permitted. An annual inspection of the parking area shall be requested by the facility and completed by the Planning Division's Code Enforcement Official. All necessary repairs and resurfacing for cracks and wear shall be completed by the company's owner within 30 days of written notification requiring such repairs. (b) On properties deeper than one hundred and fifty feet, a turnaround facility with a forty (40) foot radi s or current fire department standards for internal circulation s all be required to provide for satisfactory on-site vehicle move ent and to prevent the need to back up into traffic. (c) A twenty (20) foot wide circulation path/fi lane shall be designated and marked. This area shall be maint ned open and clear at all times. No storage of vehicles or mat rials shall be permitted within the circulation path. (d) A thirty (30) foot long by twenty lane shall be provided outside and foot wide stacking the gate area. (e) Security gates shall be a maxi m of 24 feet wide and shall not be viewable from the street w n opened. An electric gate control device to open and close t e gate shall be required. Gates shall remain closed other th during utilization for transition of vehicles in or out of e yard. Conformance (a) As used in this section, "nonconforming yard" means a junk yard, salvage yard, utomobile wrecking yard, impound yard, vehicle storage facility" or commercial vehicle storage facility which was in existence the time of the adoption of this article and which conformed to the standards established for such uses by this chapter as they isted prior to the adoption of this article, but which does not onform to the standards established by this chapter following t e adoption of this article.
