ORDINANCE NO. NS-2168
AN ORDINANCE OF THE CITY OF SANTA ANA
REPEALING SECTION 33-39, AMENDING
SECTION 33-40 AND ADDING SECTION 34-90
TO THE SANTA ANA MUNICIPAL CODE TO
AUTHORIZE THE EXECUTIVE DIRECTOR OF THE
PUBLIC WORKS AGENCY TO RELEASE BONDS
FURNISHED IN CONNECTION WITH STREET
IMPROVEMENTS AND SUBDIVISION MAP
APPROVALS
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS
FOLLOWS:
SECTION 1: That section 33-39 of the Santa Ana Municipal Code
is hereby repealed.
SECTION 2: That section 33-40 of the Santa Ana Municipal Code
is hereby amended to read as follows:
Sec. 33-40. Acceptance of street improvements.
The executive director of the public works agency shall
not accept any streets or alleys or improvements thereto until
he has determined that all requirements of this article have
been fulfilled. When the executive director of the public
works agency has determined that all work has been
satisfactorily completed and payments made as required by this
article, he, or his designated representative, may, on behalf
of the city, release any bond required for such work. Upon
the release of bonds pursuant to this section, the executive
director of public works or his designated representative
shall send written notification of such action to the clerk of
the council.
SECTION 3: That the Santa Ana Municipal Code is hereby
amended by adding a section, to be numbered 34-90, which said
section reads as follows:
Sec. 34-90. Release and reduction of security.
Whenever a subdivider has furnished security for the
performance of any act or agreement required or entered into
in connection with the approval of a subdivision map,
including security for labor and material, the executive

director of the public works agency, or his designated
representative, may release or reduce such security on behalf
of the city in accordance with section 66499.7 of the
Government Code of the State of California. Upon the release
or reduction of security pursuant to this section, the
executive director of public works or his designated
representative shall send written notification of such action
to the clerk of the council.
SECTION 4: If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held to be
invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the validity
of the remaining portions of this ordinance. The city Council of
the city of Santa Ana hereby declares that it would have adopted
this ordinance and each section, subsection, sentence, clause,
phrase or portion thereof irrespective of the fact that any one or
more sections, subsections, sentences, clauses, phrases, or
portions be declared invalid or unconstitutional.
