NS- 2224 AN ORDINANCE OF THE CITY OF SANTA ANA ADDING SECTION 8-10 TO THE SANTA ANA MUNICIPAL CODE TO REQUIRE ON ON-SITE CARETAKERS FOR LARGE APARTMENT HOUSES AND HOTELS THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 8-10, which said section reads as follows: Sec. 8-ZO. On-site caretakers for large apartment buildings and hotels. A manager, janitor, housekeeper, or other responsible person shall reside upon the premises and shall have charge of every apartment house in which there are 16 or more apartments, and of every hotel in which there are 12 or more guest rooms, in the event that the owner of any such apartment house or hotel does not reside upon said premises. Only one caretaker would be required for all structures under one ownership and on one contiguous parcel of land. If the owner does not reside upon the premises of any apartment house in which there are more than four but less than 16 apartments, a notice stating his name and address, or the name and address of his agent in charge of the apartment house, shall be posted in a conspicuous place on the premises. SECTION 2: Section 8-10 of the Santa Ana Municipal Code, as added by this ordinance, corresponds to a regulation of the Department of Housing and Community Development of the State of California: specifically, Section 42 of Article 5 of Subchapter 1 of Chapter 1 of Division 1 of Title 25 of the California Code of Regulations. It is adopted by the City of Santa Ana pursuant to the authority set forth in 17958 of the Health and Safety Code of the State of California. Pursuant to section 17964 of the said Health and Safety Code those officers and employees of the Planning and Building Agency specified in section 1-18.1 of the Santa Ana Municipal Code are charged with the enforcement of said Section 8- 10. SECTION 3: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The city Council of the City of Santa Ana hereby declares that it would have adopted 1 183 ORDINANCE NS-2224 Page 2 this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional. SECTION 4: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
