NS-2230 AN ORDINANCE OF THE CITY OF SANTA ANA ADDING REGULATIONS FOR THE C3-A (CENTRAL BUSINESS - ARTISTS' VILLAGE) DISTRICT TO THE ZONING CHAPTER OF THE MUNICIPAL CODE AND REZONING CERTAIN PROPERTY IN DOWN- TOWN SANTA ANA TO THE C3-A DISTRICT THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That the Santa Ana Municipal Code amended by adding a section, to be numbered 41-101.5, section reads as follows: is hereby which said SeO. 41--101.5. Live-work community. A live-work community is a building, or portion thereof, used for units which are each a combination of a studio/workshop and a living quarters, and may be either a building, or portion thereof, originally designed for non-residential purposes and converted to such use or a new building initially designed for such use. SECTION 2: That the Santa Ana Municipal Code is hereby amended by adding a section, to be numbered 41-158, which said section reads as follows: SeO. 41-158. Studio. A studio is the workplace of one or more individuals who are engaged in the production of works of art or handicrafts for a living, including, but not limited to, painting, sculpture, music, photography, ceramics, glass works and the performing arts. SECTION 2: That the Santa Ana Municipal Code is hereby amended by adding a division, to be numbered 14.5, to Article III of Chapter 41 thereof, which said division shall consist of section 41-401 through 41~04and shall read as follows: DIVISION 14.5. C3-A (CENTRAL BUSINESS - ARTISTS' VILLAGE) Sec. 41-401. Applicability of division. C3-A (Central Business - Artists' Village) districts are specifically subject to the regulations contained in this division. Such districts are also subject to all regulations in this chapter which apply to property located in the C3 (Central Business) district, except that sections 41-377 and 41-377.5 shall not apply 0mlm :E 2 0 9 Page 2 -' to the C3-A district. B&c · 41-402. Uses permitted in the C3-A district. The following uses are permitted in the C3-A district. (a) Retail and service uses. (b) Professional, administrative and business uses. (c) Automotive parking lots and parking structures. (d) Theaters. (e) Restaurants. (f) Commercially operated professional studios, studios listed in section 41-402. (g) The following creative arts uses: (1) Fine arts studios and/or galleries. (2) Fiber arts studios and/or galleries. (3) (4) Sec, 41-403. except for Printing, lithography and calligraphy facilities. Photography studios. Uses subject to a conditional use permit in the C3- A district. The following uses may be permitted in the C3-A district subject to the issuance of a conditional use permit: (a) Live/work communities. (b) Schools. (c) Ceramic and pottery studios. (d) Glass blowing and sculpturing studios. 41-404. Use restrictions and development standards for live/work communities in the C3-A district. The following use restrictions and development standards apply to live/work communities in the C3-A district: 2 ORDINANCE NS-2230 21 1 Page 3 (a) (b) (c) (d) (e) Residential use is permitted only in combination with individual studios in a manner which provides an inte- grated working and living environment. Density shall not exceed 22 dwelling units per acre. At least one off-street parking space shall be provided for each dwelling unit. A live/work unit shall be at least 750 square feet in size. The residential component shall be at least 550 square feet in size and the studio component shall be at least 200 square feet in size. The residential component of a live/work unit shall meet the following standards: (1) It shall have a room of at least 200 square feet. (2) It shall have separate bathroom facilities, includ- ing a water closet, a wash basin, and a bathtub or shower. (3) It shall have separate kitchen facilities including a kitchen sink, cooking appliances and refrigera- tor. All such facilities shall have a clear work- ing space of at least 30 inches in front. (4) It shall comply with all Housing Code requirements. (f) On-site laundry facilities are required if the total number of dwelling units exceeds five. SECTION 3: Pursuant to section 41-630(b)of the Santa Ana Municipal Code, the city Council hereby confirms the delegation by the Planning Commission to the Zoning Administrator of authority to act on conditional use permit applications for ceramic and pottery studios and glass blowing and sculpturing studios in the C3-A district. SECTION 4: That certain real property identified in Exhibit A, attached hereto and incorporated herein, is hereby reclassified from the C3 (Central Business) district to the C3-A (Central Business - Artists' Village) district. Amended Sectional District Map No. 12-5-10, showing the said change in use district classifi- cation is hereby approved. SECTION 5: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity 3 0 ORDINANCE NS-2230 page 4 of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional. SECTION 6: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
