ORDINANCE NO. NS-2245
AN ORDINANCE OF THE CITY OF SANTA ANA
AMENDING SECTIONS 41-199, 41-365.5, 41-
412.5, 41-424.5, AND 41-645.5 OF THE
SANTA ANA MUNICIPAL CODE, TO REQUIRE A
CONDITIONAL USE PERMIT FOR LAUNDROMATS
IN THE COMMERCIAL USE DISTRICTS
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS
FOLLOWS:
SECTION 1: That section 41-199 of the Santa Ana Municipal
Code is hereby amended to read as follows:
Bec. 41-199. Laundromats.
Laundromats may be permitted in the C1, C2, C3, C4 and C5
districts subject to the issuance of a conditional use permit.
Laundromats are not permitted in any other use district. Laundro-
mats shall comply with the following development and performance
standards:

Storefront windows must be of full length type. The vertical
plane of the glazing should extend from the top of the floor
or bulkhead to the top of the finished ceiling height.
Bulkheads, if provided, shall be a maximum of 1 (one) foot in
height above the finished floor level. The horizontal plane
should extend completely across the storefront except where
shear panels are required by the Building Code.
Glazing material must be approved by the Planning Division and
the Police Department for color and tint. Tint must not
exceed 10%. Reflective glass will not be permitted.
(c) Interior lighting must be approved by the Police Department.
The minimum level shall be 1 (one) footcandle as per Santa Ana
Municipal Code.
(d) All service counters, seating areas, service sinks, and coin
operated dispenser machines must not create an obstructed view
of the entire interior assembly space. No displays, posters,
or other obstructive material shall be installed on or near
the storefront windows.

No public telephones shall be located within the laundromat.
No electronic video games, billiard games, or other gaming
devices shall be allowed within the laundromat. No laundromat
use may be initiated within 300 feet of any individual tenant

space having more than 5% of its floor area used for electron-
ic video games, or other gaming devices.
(g) Public rest rooms shall be locked at all times and available
only through the request of the attendant on duty.
(h) Service corridors shall be locked during all normal business
hours. Storage/access doors shall be 1 3/4 inch thick and
secured with an approved dead bolt and non-removable hinge
pins.
(i) Rear exits are prohibited unless required by either the
Building Code or the Fire Code. When required, rear exit
doors shall be kept in a locked closed position and shall have
panic hardware.

Hours of operation shall be restricted to 7:00 a.m. to 10:00
p.m.
A sign prohibiting loitering on the premises in accordance
with section 10-96 of this code shall be kept posted on the
premises at all times.
The exterior parking area must be illuminated to a minimum of
one footcandle for sixty (60) feet horizontally in all
directions from the laundromat tenant space.
SECTION 2: That section 41-365.5 of the Santa Ana Municipal
is hereby amended to read as follows:
41-365.5 Uses subject to a conditional use permit in the C1
district.
The following uses may be permitted in the Cl district subject
to the issuance of a conditional use permit:
(a) Clubs.
(b) Outdoor and indoor recreational or entertainment uses
other than those set forth in section 41-365.
(c) Hotels, motels, lodging houses, care homes, fraternity
houses and sorority houses.
(d) Thrift shops.
(e) Eating establishments with drive-through window service.
(f)
Eating establishments open at any time between the hours
of 12:00 midnight and 5:00 a.m. and located within 150
feet of residentially zoned or used property, measured

(g)
from property line to property line.
Laundromats, subject to the development and performance
standards set forth in section 41-199.

SECTION 3: That section 41-412.5 of the Santa Ana Municipal
is hereby amended to read as follows:
41-412.5. Uses subject to a conditional use permit in the C4
district.
The following uses may be permitted in the C4 district subject
to the issuance of a conditional use permit:
(a) Hotels, motels, lodging houses, care homes, fraternity
houses and sorority houses.
(b) Indoor swap meets, bulk merchandise stores, and home
improvement warehouse stores.
(c) Eating establishments with drive-through window service.
(d) Eating establishments open at any time between the hours
of 12:00 midnight and 5:00 a.m. and located within 150
feet of residentially zoned or used property, measured
from property line to property line.
(e)
Laundromats, subject to the development and performance
standards set forth in section 41-199.

SECTION 4: That section 41-424.5 of the Santa Ana Municipal
is hereby amended to read as follows:
41-424.5. Uses subject to a conditional use permit in the C5
district.
The following uses may be permitted in the C5 district subject
to the issuance of a conditional use permit:
(a) Hotels, motels, lodging houses, care homes, fraternity
houses, and sorority houses.
(b)
Dwelling units when erected above the ground floor of a
commercial structure when the ground floor is devoted
exclusively to nonresidential uses.
(c) Hospitals.
(d) Public utility structures, including electric distribu-
tion and transmission substations.

(e) Eating establishments with drive-through or walk-up
window service.

Service stations and automobile servicing.
Car wash establishments, provided they are wholly
enclosed.
Laundries.
Indoor swap meets, bulk merchandise stores, and home
improvement warehouse stores.
Eating establishments open at any time between the hours
of 12:00 midnight and 5:00 a.m. and located within 150
feet of residentially zoned or used property, measured
from property line to property line.
Laundromats, subject to the development and performance
standards set forth in section 41-199.
SECTION 5: That section 41-645.5 of the Santa Ana Municipal
Code is hereby amended to read as follows:
Sec. 41-645.5. Same--conditional use permits for the sale of alco-
holic beverages and for laundromats.
(a) Notwithstanding any other provision of this article, and
subject to subsection (b) of this section, the decision of the
planning commission on any application for a conditional use permit
for the sale of alcoholic beverages pursuant to section 41-196 or
for a laundromat shall be final and shall not be subject to appeal
to the city council.
(b) Within two (2) days following the date of a planning
commission decision on a conditional use permit for the sale of
alcoholic beverages or for a laundromat, the planning manager shall
send a written report of such decision to the members of the city
council. If, within twenty-one (21) days following the date of such
a planning commission decision, the city council sets the matter
for public hearing, then the decision of the planning commission
shall be vacated and the conditional use permit application shall
be heard and decided by the city council.
(c) In the event that authority to grant or deny conditional
use permits for the sale of alcoholic beverages or for laundromats
is delegated to the zoning administrator pursuant to section
41-630(b), then, with regard to any such conditional use permit,
the hearing referenced in section 61-643 shall be by the planning
commission rather than the city council, and an appeal from the

decision of the zoning administrator pursuant to section 41-645
shall be to the planning commission rather than the city council.
SECTION 6: Pursuant to section 41-630(b)of the Santa Ana
Municipal Code, the City Council hereby confirms the delegation by
the Planning Commission to the Zoning Administrator of authority to
act on conditional use permit applications for laundromats.
SECTION 7: If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held to be
invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the validity
of the remaining portions of this ordinance. The city Council of
the city of Santa Ana hereby declares that it would have adopted
this ordinance and each section, subsection, sentence, clause,
phrase or portion thereof irrespective of the fact that any one or
more sections, subsections, sentences, clauses, phrases, or
portions be declared invalid or unconstitutional.
SECTION 8: Neither the adoption of this ordinance nor the
repeal hereby of any ordinance shall in any manner affect the
prosecution for violation of ordinances, which violations were
committed prior to the effective date hereof, nor be construed as
affecting any of the provisions of such ordinance relating to the
collection of any such license or penalty or the penal provision
applicable to any violation thereof, nor to affect the validity of
any bond or cash deposit in lieu thereof, required to be posted,
filed or deposited pursuant to any ordinance and all rights and
obligations thereunder appertaining shall continue in full force
and effect.
