ORDINANCE NO. NS-2290
AN ORDINANCE OF THE CITY OF SANTA ANA
APPROVING AND ADOPTING A SECOND AMENDMENT TO
THE REDEVELOPMENT PLAN FOR THE SANTA ANA
"CENTRAL CITY" REDEVELOPMENT PROJECT
WHEREAS, the city Council of the City of Santa Ana (the "City
Council") adopted Ordinance No. NS-1173 on July 2, 1973, approving
and adopting the original Redevelopment Plan for the Santa Ana
Redevelopment Project Area, and thereafter adopted Ordinance No.
1258 on June 2, 1975 to amend the said redevelopment plan and
enlarge the project area (as amended, the "Redevelopment Plan" and
the "Project Area"); and
WHEREAS, after due notice, the City Council and the Santa Ana
Redevelopment and Housing Commission ("Commission"), performing
functions of the Community Redevelopment Agency of the city of
Santa Ana ("Agency") pursuant to Resolution No. 91-102 of this
Council, held a joint public hearing to consider the approval and
adoption of a proposed second amendment of the Redevelopment Plan
to extend the time limit for the commencement of eminent domain
proceedings to acquire property within the Project Area (the
"Amendment"); and
WHEREAS, the Commission, following the conclusion of said
joint public hearing has recommended that the Amendment be approved
and adopted; and
W~EREAS, the City Council has considered and evaluated the
Amendment and the Environmental Impact Report prepared for the
Amendment, and has provided an opportunity for all persons to be
heard and has received and considered all evidence and testimony
presented for and against any and all aspects of the Amendment,
including environmental impacts; and
~NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES
ORDAIN AS FOLLOWS:
SECTION 1:
The Amendment is hereby approved and adopted.
SECTION 2: Based on substantial evidence in the record, the
City Council hereby finds and determines that the condemnation of
real property continues to be necessary to the execution of the
Amended Redevelopment Plan.
SECTION 3: Ail findings and determinations contained in
Ordinance No. NS-1258 remain in full force and effect.

The time limit for commencement of eminent domain proceedings to
acquire property within the project area, as established by
Ordinance No. NS-1877, is hereby amended to read as follows:
No eminent domain proceeding to acquire property
within the Project Area shall be commenced after the
date occurring twelve (12) years after the effective
dated of the ordinance approving and adopting the
Second Amendment to the Redevelopment Plan for the
Santa Ana "Central city" Redevelopment Project.
Those properties previously exempted from eminent
domain by the Agency shall remain exempt.
