ORDINANCE NO. NS- 2305
AN ORDINANCE OF THE CITY OF SANTA ANA
ADDING SECTIONS 2-109 AND 2-304 RELATED
TO CITY SPONSORED REAL ESTATE INCENTIVE
PROGRAMS.
THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS
FOLLOWS:
SECTION 1: That the Santa Ana Municipal Code is hereby
amended by adding a section, to be numbered 2-109, which section
reads as follows:
Sec. 2-109. Participation in real estate incentive programs.
(a) No Councilmember shall be eligible to participate
in, or directly or indirectly receive any benefits from,
any city Sponsored Real Estate Incentive Program, except
as provided in subsection (c) hereof.
(b) City Sponsored Real Estate Incentive Program, for
purposes of this section, shall mean any funding program
managed by the City of Santa Aha, the Redevelopment
Agency, the Housing Authority, or other agency which is
administered or funded, in whole or in part, by the City
of Santa Ana, and which provides loans, grants or other
monetary or economic benefits to individuals or business
entities to be used for the acquisition, construction,
repair or improvement of real property.
(c) The prohibitions set forth in this section shall be
inapplicable where they are in conflict with state or
federal law.
SECTION 2: That the Santa Ana Municipal Code is hereby
amended by adding a section, to be numbered 2-304, which section
reads as follows:
Sec. 2-304. Participation in real estate incentive programs.
(a) No member of a board or commission, city officer or
employee, who in the course of his or her duties is
required to participate in the formulation of policies
for, or implementation of, any City Sponsored Real Estate
Incentive Program, shall be eligible to participate in,
or directly or indirectly receive any benefits therefrom,
except as set forth in subsection (c) hereof.
(b) City Sponsored Real Estate Incentive Program, for
purposes of this section, shall have the same meaning as
set forth in Section 2-109 of Article II of Chapter 2 of
ORDINANCE NS-2305

the Santa Ana Municipal Code, as it exists now or as
amended in the future.
(c) The prohibitions set forth in this section shall be
inapplicable where they are in conflict with state or
federal law.
SECTION 3: If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held to be
invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the validity
of the remaining portions of this ordinance. The City Council of
the city of Santa Ana hereby declares that it would have adopted
this ordinance and each section, subsection, sentence, clause,
phrase or portion thereof irrespective of the fact that any one or
more sections, subsections, sentences, clauses, phrases, or
portions be declared invalid or unconstitutional.
SECTION 4: Neither the adoption of this ordinance nor the
repeal hereby of any ordinance shall in any manner affect the
prosecution for violation of ordinances, which violations were
committed prior to the effective date hereof, nor be construed as
affecting any of the provisions of such ordinance relating to the
collection of any such license or penalty or the penal provision
applicable to any violation thereof, nor to affect the validity of
any bond or cash deposit in lieu thereof, required to be posted,
filed or deposited pursuant to any ordinance and all rights and
obligations thereunder appertaining shall continue in full force
and effect.
