NS-2380 AI~ ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AMENDING SPECIFIC DEVELOPMENT NO. 63 TO ALLOW VARIOUS CHANGES IN THE DEVELOPMENT STANDARDS TO ACCOMMODATE THE EXPANSION OF THE ORANGE COUNTY BUSINESS CENTER LOCATED AT 1221 EAST DYER ROAD WHEREAS, this Council, by its Ordinance No. NS-2317, adopted March 17, 1997, rezoned property in the area known as Specific Development Plan No. 12 (SD-12), more specifically described in said ordinance, to Specific Development Plan No. 63 for such property; and WHEREAS, it is now development standards to appropriate land uses. desired to allow various changes in the accommodate and attract development and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN that Specific Development Plan No. 63 is hereby amended to read as follows: SPECIFIC DEVELOPMENT PLAN 63 ORANGE COUNTY BUSINESS CENTER SECTION i - APPLICABILITY OF ORDINANCE The Specific Development zoning district for the Orange County Business Center property, as authorized by Chapter 41, Division 26, Section 41-593 and the following, of the Santa Ana Municipal Code, is specifically subject to the standards and regulations contained in the plan for the express purpose of establishing land use regulations and standards. All other applicable chapters, articles, and sections of the Santa Aha Municipal Code shall apply unless expressly waived or superseded by this ordinance. SECTION 2 - PURPOSE The Specific Development 63 specific development plan for Orange County Business Center consisting of standards and regulations is hereby established for the express purpose of protecting the health, safety and general welfare of the people of the City by promoting and enhancing the value of properties and encouraging orderly development. SECTION 3 - USES PERMITTED A. Permitted uses in SD-63. Office uses or other non-retail use that are permitted in the Professional (P) or Light Manufacturing (Mi) zoning district with a parking ratio that is equal to or less than office uses. Specifically the following uses, by building, are permitted: Buildinq 1 29,500 gross square feet of office use or other non-retail uses permitted in the P or M1 zone that has an equal or lower parking ratio than office use. Buildinq 2 83,139 gross square feet of office or other non-retail uses permitted in the P or Mi zone that has an equal or lower parking ratio than office use. Buildinq 3 106,944 gross square feet of office or other non-retail uses permitted in the P and M1 zone that has an equal or lower parking ratio than office uses, and 32,282 gross square feet of manufacturing use. Buildinq 4 85,051 square feet of office use, and 7,597 gross square feet of classroom use or other non-retail uses permitted in the P and Mi zone that has an equal or lower parking ratio than office use. Building 5 73,845 gross square feet of office use or other non-retail uses permitted in the P or Mi zone that has an equal or lower parking ratio than office use. Buildinq 6 55,220 gross square feet of office, and other non retail uses permitted in the P or M1 zone that has an equal or lower parking ratio than office use. Buildinq 7 1,400 square feet restaurant, deli, or caf~ use. B. Expansion. Building expansion of any building is allowed up to 10 percent of the entitled gross square footage provided the increase does not exceed the overall cap of 474,978 gross square feet. Parking must be provided on-site to accommodate the additional square footage. Compliance. Ail uses, locations, and sizes of buildings, site circulation, and architectura!~presentation shall abide in all respects to the Santa Aha Municipal Code, Parking Structure Standards and the documents attached as Exhibits to Specific Development No. 63 and all comments of record pertaining to and/or modified to comply with site plan Review No. DP 98-063. Section 4 - OPERATIONAL STANDARDS A. Parking Requirements. Required parking shall be in conformance with the design standards of the Santa Ana Municipal Code and in effect at the time parking facilities are constructed. The minimum number of parking stalls to be provided are: Office: Three spaces per 1,000 gross square feet of floor space. o Manufacturing: Two spaces per 1,000 gross square feet of floor space. o Warehouse: One space per 1,000 gross square feet of floor space. Other Uses: Parking to be provided as stipulated in the City of Santa Ana Zoning Code. Total Parking Required: 1,561 parking spaces for building area square footage as noted under Section 3. Ail parking spaces on-site to be standard size spaces as provided for in the City of Santa Ana Zoning Code. Ail compact spaces on-site to be converted to standard spaces prior to issuance of next Building permit. B. Parkinq Structure Design to be as provided for in the City of Santa Ana Parking Structure Standards. Architecture to be compatible with the existing development and sensitive to the surrounding hotel terrace development. Section 5 - LANDSCAPING AND SET BACK REQUIREMENTS Front yard setback (east) The minimum dimension of the front yard is a landscaped area of not less than 21 feet in depth fronting on Dyer Road with exception to approved driveways and an area between the proposed bus turn-out and the parking area. The area must be 80 feet wide and 320 feet long. The area can accommodate a 1,400 square foot building for delicatessen use per the approved site plan. Maintain an 18 foot deep landscaped area along the central interior entry drive. Vehicles are permitted to overhang two feet into the landscaped area per the approved site plan. SECTION 6 - BUILDING MATERIALS AND COLORS Ail buildings must be constructed of compatible materials and colors as the existing buildings. All buildings will be primarily concrete and be colored white, gray, or off-white. The use of blue tinted glass and glass block as accents to the architecture are required. SECTION 7 - PUBLIC ART The display of public art is encouraged within the Orange County Business Center. Public art is a condition of an on-site parking structure. The value of the public art is to be one percent of the parking structure's Building permit valuation.
