ORDINANCE NO. NS- 2390
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA AMENDING SPECIFIC
DEVELOPMENT NO. 43 TO ALLOW VARIOUS
CHANGES IN THE SIGNAGE AND STREET
FRONTAGE REQUIREMENTS FOR THE MACARTHUR
PLACE DEVELOPMENT (ZOA NO. 99-03)
WHEREAS, this Council, by its Ordinance No. NS-1941, adopted
January 4, 1988, rezoned property in the area known as MacArthur
Place, more specifically described in said ordinance, to Specific
Development Plan No. 43 for such property; and
WHEREAS, it is now desired to allow various changes in the
signage and street frontage requirements for the appropriate land
uses.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA
DOES ORDAIN AS FOLLOWS:
1. The amendments to district designation and Specific
Development Plan No. 43, as proposed in Zoning Ordinance Amendment
No. 99-03, are hereby found and determined to be consistent with
the General Plan of the City of Santa Ana and otherwise justified
by the public necessity, convenience and general welfare.
2. That amendments to Specific Development No. 43, as set
forth in Exhibit 1, attached hereto and incorporated herein, are
hereby approved and adopted for the abovesaid property.

SECTION VII (SIGNS) OF SPECIFIC DEVELOPMENT PLAN NO. 43 IS AMENDED IN ITS
ENTIRETY AS FOLLOWS: '
VII. SIGNS
I, INTENT
Intent and Purpose. The intent and purpose' of this section is to describe
permitted sign types and provide standards for signs within the MACARTHUR PLACE
Specific Development Plan. Components of the MACARTHUR PLACE signage include
identification signs, directional signs, and entry signs, among others. Because of the
unique size, location, and mixed use elements within the MACARTHUR PLACE
Specific Development Plan Area, the sign components and standards described in this
Section are designed to take into account MACARTHUR PLACE's unique character in
order to adequately serve visitors, employees, and other users of MACARTHUR
PLACE.
II. DEFINITIONS
The following definitions apply to this Section VII including the principal sign
types set forth in the attached chart.
"Building Mezzanine Level" means the location occurring immediately
above the ceiling level of the first floor and immediately below the flOor Jevel of the
second floor.
"FreeWay'' means the State Route 55 (Costa Mesa) Freeway.
"Freeway Parcel" means the one lot, among the lots whose primary
eastern frontage is adjacent to and oriented to the Freeway (or fronting or adjacent
to a storm drain or other channel or similar improvement located between such lot and
the Freeway), that has the most lineal feet fronting the Freeway (or the intervening
storm drain or other channel).
"Freeway Parcel Owner" means the owner of the Freeway Parcel. The
Freeway Parcel Owner may, but is not required to be, the Major Parcel Owner.

"Freeway Parcel Tenant" means the Primary Tenant of the building
located on the Freeway Parcel. The Freeway Parcel Tenant may, but is not required
to be, the Freeway Parcel Owner or the Major Parcel Owner.
"Major Parcel Owner" means the one person, firm, or entity, when
including all related, associated, affiliated, subsidiary, or controlled entities, that owns
the most land acreage within MacArthur Place regardless of the number of parcels,
whether contiguous or non-contiguous, comprising such land acreage.
"Major Tenant" means, when including all related, associated, affiliated,.
subsidiary, and controlled entities, the person, firm, or entity occupying more building
square footage of the buildings located on the portion of MacArthur Place owned by
the Major Parcel Owner, than any other tenant or occupant in such buildings. The
Major Tenant and the Major Parcel Owner may be the same person, firm, or entity.
"Office Tower" means an office building with three or more stories.
"Office Towers Complex" means two or more Office Towers designed
in architectural style and theme to be an integrated office development.
"Primary Tenant" means up to, but not exceeding, three (3) tenants or
occupants in an office building that are designated by the building owner to obtain
signage related to such office building as permitted by these sign regulations.
· - "Ground Floor Tenant" means up to, but not exceeding, two (2) tenants
or occupants located on the ground level floor of an office building.
III.
SIGN TYPES AND STANDARDS
Principal MacArthur Place Siqn Types and Standards
The principal MACARTHUR PLACE sign types, and the standards and
regulations applicable to those principal sign types, are set forth in the
following charts.

Incidental signs shall be permitted, including but not limited to
miscellaneous vehicle and pedestrian directional .signs, parking signs,
loading/delivery signs, hours of operation signs, handicap access signs,
water control and landscaping signs, entry gate signs, and code required
signs, shall be provided and shall be in accordance with applicable City,
state, and federal code standards and shall to the extent possible be
consistent with signage used in MacArthur Place in the vicinity of such
signs.
Other Commercial and Retails Si.qns; Residential Siqns
All signs pertaining to commercial and/or retail uses not otherwise
provided for in this Section VII (Signs), and all signs Pertaining to
residential uses, shall be subject to the approval of the Planning Director.
Legal Nonconform n.q Signs
Any signs existing within MacArthur Place at the time these sign
standards are adopted that are inconsistent with these sign standards
shall be considered legal nonconforming signs.
Prohibited Signs
Marquee signs with the exception of theater signs approved by the
Planning Director, roof-top signs, flashing signs, and rotating or revolving
signs shall not be permitted.
IV. ADDITIONAL STANDARDS
Building tenants and occupants that are not Major Tenants, Primary
Tenants, or Ground Floor Tenants, or an Office Tower or Office Tower
Complex, shall be restricted to interior tenant directory listings.
All sign typefaces shall be sUbject to the reasonable approval of the
Planning Director.
Tenant signs visible from the exterior of any building shall be devised or
constructed so as not to rotate, gyrate, blink, move, or appear to move
in any fashion.

Tenant signs that include public service devices such as clocks and
temperature indicators shall be devoid of advertising.
Due to the unique character of MACARTHUR PLACE, there shall be a
minimum of twenty-five feet (25') of separation between any
freestanding ground monument signs; provided, however, that the
foregoing requirement shall be calculated without including the following:
Freeway Identification Sign, MacArthur Place Identification Signs, Major
Tenant Perimeter Street Frontage Identification Sign, or any ground
monument sign containing an Office Tower(s) identification.
No "off premises" signs, as defined in Section 41-1103 of the Santa Ana
Municipal Code, shall be pe'rmitted with the exception of:
1. The Major Tenant Perimeter Street Frontage Identification Sign
(see attached chart for this sign type).
Repair and maintenance of all wall mounted and/or free standing tenant
identification signs are the direct responsibility of the owner or tenant.
Applicants for any sign permit, sign program, sign variance, or other
approval from the City pertaining to signs must, with the application,
provide evidence of prior approval by the Architectural Committee of
MacArthur Place Owner's Association.
LIGHTING GUIDELINES
A. Objectives
1. To contribute to the safe and efficient use of a development site.
2. To contribute to site security.
3. To complement and reinforce the architecture and site design
character.
4. To have lighting fixtures and illumination levels for on-site parking
consistent throughout MACARTHUR PLACE District Center.
5. To prevent casting glare onto adjacent lots.
6. To prevent casting glare onto adjacent streets in such a manner
as to decrease the safety of vehicular movements.
7. To encourage lighting design that is in conformance with energy
saving guidelines.

Guidelines
All lighting potentially visible from an adjacent street except
bollard lighting less than forty-two (42) inches high, shall be
indirect or shall incorporate a full cut off shield type fixture.
Parking areas, access drives, and internal vehicular circulation area
lighting fixtures shall be a zero cutoff. The parking lot illumination
level shall achieve a uniformity ratio of 3 to I (average to
minimum) with a maintained average of 3.0 foot candle and a
minimum of 1.0 foot candle.
Service area lighting shall be contained within the service yard
boundaries and enclosure walls. No light spillover should occur
outside the service area. The light source should not be visible
from the street.
Building illumination and architectural lighting shall be indirect in
character. No light source visible. Indirect wall lighting or "wall
washing" overhead down lighting, or interior illumination which
spills outside is encouraged. Architectural lighting should
articulate and animate the particular building design as well as
provide the required functional lighting for safety and clarity of
pedestrian movement.
5. Pedestrian walk lighting is divided into two types of areas.
Primary areas. Outdoor pedestrian use areas such as
courtyard, entry way, etc. Pedestrian lighting should
achieve a foot candle minimum of 1, with an average
illumination of .60 foot candles and a minimum of .18 foot
candles.
Secondary areas. Walk 'lighting where point to point
lighting is acceptable with no specific illumination levels
required. The main emphasis in this areas should be to
clearly identify the pedestrian walkway and direction of
travel.
VI.
INTERPRETATION
This Section VII sets forth sign and related standards for MACARTHUR PLACE
in accordance with Division 3 of Article XI (commencing with Section 41-880)
of the Santa Aha Municipal Code. In the event of any conflict between the
standards set forth in this Section VII pursuant to the authority granted in

Division 3 of Article Xl (commencing with Section 41-880) of the Santa Ana
Municipal Code, and the sign standards set forth in other chapters, divisions,
section.s, or paragraphs of the Santa Ana Municipal Code, this Section VII shall
control.
VII. ENFORCEMENT
The penal provisions and permit requirements set forth in Article Xl of the
Santa Aha Municipal Code (effective as Of the date of adoption of this Specific
Development Plan, or as to any amendments to this Section 'VII (Signs), the
date of adoption of any amendment to this Section VII [Signs]), shall apply to
all signs within the MacArthur Place District' Center.

Paragraph C ("Site Coverage") under the heading "Professional and Business
Offices/Commercial/Retail/Hotel" of Section V (Development Standards) of Specific
Development Plan No. 43, is amended as follows:
V. DEVELOPMENT STANDARDS

[Paragraph "C" titled "Site Coverage" appearing on page 13 of specific
Development Plan No. 43 is retitled and amended to read as follows (added
language shown in underline]:
Site Coverage/Lot Frontage
All building setbacks as described in B. above and as shown in Exhibit
B shall be provided. Building setbacks shall be maintaine(J for site
coverage. Site coverage for individual parcels or tracts is unlimited,
provided that the setbacks described above are maintained..Each lot
shall have at least one hundred twenty (120) feet of street fronta.qe as
set forth in Section 41-373 of the City of Santa Ana Municipal Code,
with the exception of:
1_~. Parcel 6 of Tentative Parcel Map 98-232, which may have less
than one hundred twenty (120) feet, but shall not have less than
