NS- 2 3 9 8 AN ORDINANCE OF THE CITY CQUNCIL OF THE CITY OF SANTA ANA AMENDING VARIOUS SECTIONS OF CHAPTER 31 AND 36 OF THE SANTA ANA MUNICIPAL CODE TO PROHIBIT SKATEBOARDING AND ROLLER SKATING ~N THE CIVIC CENTER PLAZA, SASSCER PARK, CENTENb/[,I~AL REGIONAL PARK, ROSITA PARK, PORTOLA PARK/AND CABRILLO PARK AS WELL AS ROLLER SKAT~G ON SIDEWALKS IN A BUSINESS DISTRICT. ~ WHEREAS, the City of Santa Ana desires to ensure the safetf of pedestrians and vehicular travel within City limits; and ~ WHEREAS, public property is being defaced by the use/6f skateboards and roller skates in areas such as the Civic Center and several local parks such as ~.sscer Park, Centennial Park, Rosita Park, Portola Park, and Cabrillo Park; and ~ WHEREAS, the use of skateboards and roller skags pose significant hazards to pedestrians in the Civic Center and in several local parks because ~ff the high concentration of pedestrians as well as the regular use of pedestrian walkways such as ~tairwells, retaining walls near sidewalks and handrails as skating areas; and // / WHEREAS, it has become necessary to boja the use of such recreational equipment to avoid further damage and potential injuries to resident/and visitors of Santa Aha; and WHEREAS, the use of skateboards on/~idewalks in business districts is currently prohibited, however, roller skating on sidewalks in bush'less districts, which is not regulated, presents the same risks as skateboarding; / NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: / / / SECTION 1: That Santa Ana Mu~cipal Code section 36-17--36-24 is hereby adopted to read as follows: / / Sec. 36-17. Roller skate. / Roller skate shall mean any~otwear or device with any number of wheels which may be attached to the foot or footv/ear and which is designed to be or can be propelled by human power, and which is not cl)tssified as a bicycle o Ikateboard in thi~ Ccwl,~ Th~? defin:.t:.cn includes, but is not limite~l to, in-line skates.  ~ ' E COU?,CIL 206 Sec. 36-18. Civic Center. For purposes of this Chapter the Civic Center is that area in the City of Santa Ana, County of Orange, State of California, bounded by Sycamore Street on the east, Civic Center Drive West on the north, Shelton Street on the west, and Santa Ana Boulevard on the south. Secs. 36-19--36-24. Reserved. SECTION 2: That Santa Ana Municipal Code section 36-41 is hereby adopted to read as follows: Sec. 36-41. Miscellaneous driving movements and acts prohibited. No person shall: (1) Drive between the vehicles comprising a funeral procession while it is in motion and when such vehicles are identified as part of such procession by the display upon the outside of each vehicle of a pennant or other identifying insignia or by such other method as may be determined and designated by the chief of police. This provision shall not apply at intersections where traffic is controlled by traffic-control signals or police officers. (2) While riding any bicycle, motorcycle, coaster, skateboard, motorized skateboard, roller skates, or any toy vehicle, attach the same or himself to any moving vehicle upon any roadway, and no person driving any vehicle shall permit the same to be done. (3) Drive any motor vehicle within or over any sidewalk area or any parkway except at a driveway. (4) Drive over or across any new pavement or freshly painted marking, when any street barrier, sign or marking is in place, warning persons not to drive over or across the same, or when a sign is in place stating that the street, or any portion thereof, is closed. (5) Drive or operate a vehicle contrary to the directions or provisions of any barrier or sign erected pursuant to the provisions of any ordinance of the city, or by any public utilities, or by any department of the city, or by any other person pursuant to law or contract with the city, and no unauthorized person shall move or alter the position of any such barrier or sign. (6) Drive a vehicle onto or from any freeway except at such entrances and exits as are established by public authority. 207 (7) Park any vehicle within three hundred (300) feet of any fire apparatus which is stopped in answer to a fire alarm. Ride a bicycle, skateboard or roller skates upon a sidewalk within a business district, as that term is defined in California Vehicle Code, Section 235. Whenever any person is riding a bicycle, skateboard or roller skates upon a sidewalk other than in a business district, or in any other public place, such person shall yield the right-of-way to any pedestrian. (9) Drive a vehicle into an intersection or a marked crosswalk unless there is sufficient space on the other side of the intersection or crosswal~o accommodate the vehicle he is operating without obstructing the passage of~ther vehicles or pedestrians in such intersection or crosswalk, notwithstandi~)~ any official traffic- control device or signal indication to proceed. / / (10) Drive any motor vehicle upon or over a median. (11) Ride a skateboard or use roller skates within the Ci~/m C_enter._Any person convicted of violating this subsection shall be pu~fished by a fine x~hich shall not exceed twenty five dollars ($25.00) and for any/gubsequent convictions within one year shall be punished with a fine which/d6es not exceed seventy five dollars ($75.00). 3/~1-1 SECTION 3: That Santa bna Municipal Code section is hereby adopted to read as follows: Sec. 31-1. Definitions. / Unless the particular provisions or the context ot/~.rwise requires, the definitions and provisions contained in this section shall govern the cons[ruction, meaning and application of words and phrases used in this chapter. / / The words "amplified sound" me~¢music or speech projected or transmitted by artificial (1) means including, but not l)~nited to, amplifiers, loudspeakers or any similar devices. / (2) The word "department" mea~ the recreation and parks department of the City of Santa And. (3) The word "director" mean~ the director of the recreation and parks department. (4) The word "park" means/any public park or recreation or playground area or building or facility thereon/within the City of Santa And, owned and maintained by the city as a public park 9'r recreation or playground whether been formally dedicated to such ~~'0t Ck[~:.'~ OF THE 208 (5) (6) (7) (8) (9) (10) (11) (12) (13) (14) (15) The word "pollution" means the contamination or other alteration of the physical, chemical or biological properties of park waters. The word "stadium" means the Eddie West Field-Santa Ana Stadium. The word "vehicle" includes any wheeled device or conveyance, whether propelled by motor, animal or human power. The term shall include any trailer in tow of any kind, size or description. Exception is made for baby carriages and vehicles in the service of the city. The word "zoo" means the zoo in Prentice Park. The word "roller skate" means any footwear or device with any number of wheels which may be attached to the foot or footwear and which is designed to be or can be propelled by human power, and which isnot classified as a bicycle or skateboard in this Code. This definition includes, but is not limited to, in-line skates. The word "skateboard" shall mean any vehicle, device or conveyance with any number of wheels, with a riding surface of any design upon which a person may place one or more feet, and which is designed to be or can be propelled by human power, and which is not classified as a bicycle in this Code. "Sasscer Park" is that park which is located at 502 W. Santa Ana Boulevard in the City of Santa Ana, County of Orange, State o£ California, and is found at the southwest comer of Santa Ana Boulevard and Ross Street. "Rosita Park" is that park which is located at 706 N. Newhope Street in the City of Santa Ana, County of Orange, State of California, and is found at the southwest comer of Hazard Avenue and Newhope Street. "Centennial Regional Park" is that park which is located at 3000 W. Edinger Avenue in the City of Santa Ana, County of Orange, State of California, and is found at the southwest comer of Edinger Avenue and Fairview Street. "Portola Park" is that park which is located at 1700 E. Santa Clara in the City of Santa Ana, County of Orange, State of California, and is found at the northeast comer of Portola Street and Mabury Street. "Cabrillo Park" is that park which is located at 1620 E. Fruit Street in the City of Santa Ana, County of Orange, State of California, and is found at the southeast comer of Cabrillo Park Drive and Fruit Street. 209 SECTION 4: That Santa Ana Municipal Code section 31-1.5 is hereby adopted to read as follows: Sec. 31-1.5. Skateboards and Roller skates. No person shall ride a skateboard or use roller skates within the following parks: (1) Sasser Park; (2) Rosita Park; (3) Centennial Regional Park; (4) Portola Park; (5) Cabrillo Park. / Any person convicted of violating this section shall be deemed guilty of an in, action and upon conviction thereof shall be punished by a fine which shall not exceed twe.nt?/l]ve dollars ($25.00) and for any subsequent convictions within one year shall be pun~ed with a fine which does not exceed seventy five dollars ($75.00). / /f day of August. 1999.
